It is the policy of the Municipality of Murrysville
that it will provide a drug-free workplace by publishing a statement
that employees will not distribute, possess or use a controlled substance
in the workplace; a drug-free awareness program has been established
to inform employees about the danger of drug abuse, available drug
counseling, rehabilitation and employee assistance programs, and the
penalties that may be imposed upon employees for workplace drug abuse
violations; that compliance with the policy is a condition of employment;
employees must notify the Municipality of any criminal drug conviction
for a workplace violation within five days; the Municipality will
take appropriate action including termination of any employee who
is convicted of using drugs in the workplace; and the Municipality
will make a good-faith effort to continue to maintain a drug-free
workplace.
The Municipality upon learning of an employee's criminal
drug offense conviction will be provided, within 10 days, a written
notice of the conviction. The Municipality will then take appropriate
action against the employee, which might include firing the employee.
Termination, however, is not mandatory and less stringent disciplinary
action is permitted. The regulations provide that any personnel action
must be consistent with Section 504 of the Rehabilitation Act of 1973,
which prohibits discrimination on the basis of handicap in programs
receiving federal financial assistance.
