Article I General Provisions

§ 266-1 Definitions and interpretation.

Words and phrases, when used in this article, shall have the meanings ascribed to them in the Vehicle Code of Pennsylvania, as now in force, or as hereafter amended, enacted or reenacted,[1] except where the context clearly indicates a different meaning.

In this article, the singular shall include the plural, the plural shall include the singular, and the masculine shall include the feminine.

§ 266-2 Manner of adopting permanent traffic and parking regulations.

All traffic and parking regulations of a permanent nature shall be enacted as ordinances or as parts of ordinances or as amendments to ordinances of the Borough of New Wilmington.

§ 266-3 Temporary and emergency regulations.

The Mayor shall have the following powers to regulate traffic and parking temporarily and in time of emergency:

(1)

In the case of fire, flood, storm or other emergency: to establish temporary traffic and/or parking regulations.

(2)

In the case of emergency or to facilitate public works or in the conduct of parades, processions or public events: to restrict or prohibit traffic and/or parking in limited areas for periods of not more than 72 hours.

Such temporary and emergency regulations shall be enforced by the Mayor and the Police Department in the same manner as permanent regulations. Any person who shall operate or park a vehicle or tractor in violation of any such regulation or who shall move, remove, destroy, injure or deface any sign erected or posted to give notice of any such regulation shall be liable to the penalty set forth in the law or elsewhere in this article for a violation of such nature and, in case of a violation for which no specific penalty is set forth in the law or elsewhere in this article, to a fine of not more than $50 and costs of prosecution.

§ 266-4 Experimental regulations.

The Borough Council may, from time to time, designate places upon and along the streets and alleys in the Borough where, for a period of not more than 90 days, specific traffic and/or parking regulations, prohibitions and restrictions shall be in force and effect, and shall designate such locations by proper signs and markings. Such regulations, prohibitions and restrictions shall be effective just as if they had been specified in this article. No person shall operate or park a vehicle or tractor in violation of any such regulation, prohibition or restriction, and no person shall move, remove, destroy or deface any sign or marking erected or made by authority of this section. Any person who shall violate any of the provisions of this section shall, upon conviction thereof before the Mayor or a District Justice, be liable to the penalty set forth in the law or elsewhere in this article for a violation of such nature and, in case of a violation for which no specific penalty is set forth in the law or elsewhere in this article, to a fine of not more than $10 and costs of prosecution. The purpose of this section is to allow for the test and experimental determination of the feasibility and desirability of permanent changes in the ordinances of the Borough relative to traffic and parking.

§ 266-5 Authority of police officers.

The police officers of the Borough are hereby given authority to direct traffic on the highways in the Borough and at intersections thereof.

§ 266-6 Motor vehicles not to be driven on sidewalks.

No person shall operate any motor vehicle longitudinally upon any sidewalk in the Borough, nor shall any person operate any motor vehicle upon or across any sidewalk except in order to gain access to or egress from a driveway or alley at such locations where the curb, if such sidewalk is curbed, shall have been properly cut down for the purpose.

Any person who shall violate any of the provisions of this section shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of not more than $50 and costs of prosecution.

§ 266-7 Speed limits established on certain streets.

The following speed limits are hereby established:

(1)

Ten miles per hour on all streets, drives and other roadways in any park area.

(2)

Twenty-five miles per hour:

Twenty-five miles per hour on all streets in the Borough not restricted by this article or by any law of the Commonwealth of Pennsylvania to a lower speed limit.

Any person who shall operate a vehicle or tractor at a speed in excess of that hereby established therefor, upon any of the portions of streets herein specified, shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of $10 and costs of prosecution.

§ 266-8 Traffic signals at certain locations.

At the following locations, official traffic signals shall be erected (or if heretofore erected are hereby ratified), and traffic at such intersections shall be directed by such signals:

(1)

Neshannock Avenue and Market Street.

Any operator of a vehicle or tractor who shall disobey the directions of any traffic signal shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of $5 and costs of prosecution.

§ 266-9 One-way streets established.

The following are hereby established as one-way streets:

Any person who shall operate a vehicle or tractor upon any street or portion thereof hereby established as a one-way street other than in the direction established hereby for vehicular traffic shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of not more than $10 and costs of prosecution.

§ 266-10 Through highways established.

The following streets within the Borough of New Wilmington, between the points herein indicated, are hereby established as through highways, and the operator of every vehicle or tractor, upon approaching any such through highway upon any intersecting street or alley (except at an intersection where traffic shall be controlled by official traffic signals) shall come to a full stop, within a reasonable distance, before entering upon or attempting to cross such through highway:

Any operator of a vehicle or tractor who shall fail to come to a full stop, within a reasonable distance, before entering upon or attempting to cross any through highway, as herein above required, shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of $5 and costs of prosecution.

§ 266-11 Stop intersections established.

Stop intersections.

(1)

The following intersections, located in the Borough of New Wilmington, are hereby established as stop intersections, and official stop signs shall be erected (or are hereby confirmed if heretofore erected) in such a position as to face traffic approaching the second-named street upon the first-named street, in the direction or directions hereby indicated. All vehicles and tractors approaching any such intersection upon the first-named street, in the direction or directions hereby indicated in each case, shall come to a full stop, within a reasonable distance, before entering such intersection.

The following named streets are hereby designated as stop streets, and all traffic on such streets shall come to a complete stop at each intersection:

Cherry Street.

Chestnut Street.

Haw Street.

Jackson Street.

Landon Avenue.

Rain Street.

New Castle Street North of Neshannock Avenue is designated a stop street at its intersection with Neshannock Avenue and its intersection with Wood Street, but is not a stop street at its intersection with Landon Avenue.

Wood Street is designated a stop street at its intersection with New Castle Street.

Beechwood Road, in a westbound direction only, is designated a stop street at its intersection with Laury Lane.

Maple Street is designated as a stop street for traffic, traveling in any direction, entering the circle located at its intersection with Westminster Drive.

Any operator of a vehicle who shall fail to come to a full stop, within a reasonable distance, before entering any such stop intersection, as hereinabove required, shall, upon conviction thereof before the Mayor or a District Justice, be sentenced to pay a fine of $5.

§ 266-12 Play highways authorized.

The Mayor is hereby authorized to designate as "play highway," whenever he shall deem such action advisable and for whatever period of time directed by him, any portion of any street or alley in the Borough, whereon sledding and coasting shall be permitted. No person shall operate any motor vehicle upon any play highway at any time when such highway shall be so designated, except in case of emergency, with special permission of the Mayor or of the police officer in charge, who shall first clear such play highway of all persons using such highway for the purpose for which it was set aside.

Any person who shall violate any of the provisions of this section shall, upon conviction thereof before the Mayor or any District Justice, be sentenced to pay a fine of not more than $10 and costs of prosecution.

§ 266-13 Parking without lights authorized.

The boundary limits of the Borough of New Wilmington are hereby established as a zone in which motor vehicles may remain standing without lights, and all streets and alleys within such boundary limits are hereby designated as streets and alleys where motor vehicles may remain standing without lights.

§ 266-14 Vehicles to park within marked spaces.

Wherever a space shall be marked off on any street or alley for the parking of an individual vehicle, every vehicle there parked shall be parked within the limits bounding such space.

§ 266-15 Parking prohibited on all alleys.

Parking shall be prohibited at all times on any and all alleys in the Borough.

§ 266-16 Parking prohibited between 3:00 a.m. and 6:00 a.m.

It shall be unlawful for any person to park a vehicle or tractor, or to allow the same to remain parked, on any street, alley or Borough public parking lots in the Borough at any time between 3:00 a.m. and 6:00 a.m.

§ 266-17 Parking prohibited in certain locations.

Parking shall be prohibited at all times between the edge of the street and the property side edge of the sidewalk, leaving free of parking at all times the area between the street edge and the sidewalk edge and the sidewalk itself.

Parking shall be prohibited at all times in the following locations unless otherwise stated herein:

The above-prescribed time limits shall not apply in the vicinity of churches on Sunday mornings.

No person shall park a vehicle or allow the same to remain parked on the premises of the Borough of New Wilmington located at its Municipal Building at 134 High Street, except in parking spaces supplied therefore and only as follows:

While transacting business at the Borough Municipal Building; or

(2)

While engaged in an emergency situation as a member of the New Wilmington Volunteer Fire Company.

§ 266-19 Violations and penalties for parking violations.

Any person who violates §§ 266-14 through 266-18 of this article shall be fined the sum of $25; provided, however, if such violation is for parking illegally in a space reserved for handicapped persons, the fine shall be $40.

The fines imposed pursuant to Subsection A above shall be paid within 10 days of the violation. If the fine is paid in full within 10 days, the fine of $40 shall be discounted to $25, and the fine of $25 shall be discounted to $15.

In the event any fine imposed under Subsection A above remains unpaid on the 30th day following the violation, criminal proceedings may be instituted as provided by law and the Rules of Criminal Procedure. The issuing authority may increase the fine to the maximum amount permitted by law and assess costs of prosecution. In the event either deadline imposed by this section shall fall on a Saturday, Sunday or legal holiday, the time for compliance shall be extended to the close of the next business day.

§ 266-20 Nonmotor vehicles in parking lots.

No person or persons shall use any of the Borough parking lots for skating, rollerblading, skateboard riding, bicycle riding and similar nonmotor vehicle uses, when such activity presents a reasonable danger of injury to persons or to property (including injury to the parking lot itself).

Any person who violates § 266-20 Subsection A or Subsection B shall, upon conviction before a district justice, be fined no more than $50 plus costs of prosecution for the first offense and no more than $150 plus costs of prosecution for each additional offense within a twelve-month period of a similar prior offense.

§ 266-21 Provisions to be continuation of existing regulations.

The provisions of this article, insofar as they are the same as those of ordinances and regulations in force immediately prior to the enactment of this article, are intended as a continuation of such ordinances and not as new enactments. The provisions of this article shall not affect any act done or liability incurred, nor shall they affect any suit or prosecution pending or to be instituted to enforce any of those repealed ordinances or regulations.

Article II Vehicle Weight Limits

§ 266-22 Findings.

Pursuant to a study conducted by the Borough Engineer, it is the finding of the Borough Council that a maximum weight limit should be established for vehicles traveling on Beechwood Road.

§ 266-23 Definitions.

As used in this article, the following terms shall have the following meanings:

COMBINATION

Two or more vehicles physically interconnected in tandem.

VEHICLE

Every device in, upon or by which any person or property is or may be transported or drawn upon a roadway.

§ 266-24 Certain vehicle weight prohibited on certain road.

No person shall operate a vehicle or combination on Beechwood Road from State Route 956 to the Borough boundary line if the vehicle's combined total load weight exceeds 10 tons.

§ 266-25 Exemptions.

School buses, emergency vehicles and vehicles making local deliveries or pickups are exempt from the restriction imposed by this article.

§ 266-26 Violations and penalties.

Any person operating a vehicle or combination in violation of this article is guilty of a summary offense and shall, upon conviction, be sentenced to pay a fine of $150 plus $150 for each 500 pounds, or part thereof, in excess of 3,000 pounds over 10 tons.
