The Chief of Police of the Borough of Norristown and
only the Chief of Police shall have the authority to request assistance from
the County of Montgomery and any other local governmental municipality which
has adopted an ordinance participating in this Mutual Aid Pact Program in
the event of an emergency situation covered by this Article.
The Chief of Police seeking emergency aid shall do so
only by initiating the request for assistance through the Montgomery County
Communications Center in accord with procedures promulgated and agreed upon
by the participating local governmental municipalities.
The Chief of Police of the municipality requesting aid
shall be the commander in chief of all personnel sent to support the requesting
municipality at the time of the emergency and throughout the duration of the
emergency, as well as being the Chief of the personnel of his own municipality.
All responding police shall have the same authority as
that of the requesting department when acting in response to requests for
assistance pursuant to this agreement.
The Montgomery County District Attorney shall assign
an Assistant District Attorney to the requesting Chief upon request of the
requesting Chief to serve as legal adviser during the course of the emergency.
The Montgomery County Sheriff shall immediately discharge any vans needed
for transportation of prisoners upon request of the requesting Chief, and
the Montgomery County Sheriff shall further determine the availability, if
requested, of adult and juvenile detention facilities.
The participating Police Chiefs, together with Montgomery
County authorities, may establish procedures in the nature of promulgating
regulations to implement this agreement.
The County of Montgomery, through the Montgomery County
Commissioners, shall provide all insurances to provide liability coverage
for the Mutual Aid Squad and each of its individual members.
Each municipality shall pay the cost of its own personnel
when on duty in an emergency covered by this agreement, whether the duty is
within its own municipality or another municipality from which a request for
aid was sought.
The County of Montgomery, through the Montgomery County
Commissioners, shall supply equipment requested by the Mutual Aid Squad other
than that which is regularly issued equipment of each member.
This Article shall continue in full force and effect until terminated
by a subsequent ordinance of the Borough of Norristown. The agreement embodied
in this Article may only be repealed by a repealer ordinance.
