This Article V shall not apply to any private wastewater system which discharges to the wastewater facilities of the Patterson Township Municipal Authority or which discharges directly to a natural outlet by authority of a separate NPDES permit and in compliance with applicable state and federal laws.
All houses, buildings or properties which are required by other authorities to have sanitary or industrial wastewater facilities are not subject to the jurisdiction of this Part 2 if located where a public wastewater sewer is not available as specified by the provisions of Article IV, § 158-23, of this Part 2 and shall be equipped, at the owner's expense, with suitable wastewater facilities connected to a private wastewater disposal system which complies with the provisions of the Pennsylvania Sewage Facilities Act 537, as amended.[1]

Before design, alterations or construction of a private wastewater disposal system required under § 158-25 above, the owner or his agent shall first make application on forms furnished by Patterson Township for said permit. The applicant shall comply with all of the requirements of the Pennsylvania Sewage Facilities Act 537, as amended,[1] and other standards adopted pursuant to the Act, and furnish such other information relevant to the wastewater discharges as are deemed necessary to the Township's state-licensed Sewage Enforcement Officer. The permit and inspection fee is set by Patterson Township and shall be paid to the Township at the time the application is made.

The type, capacity, location and layout of private wastewater disposal systems shall comply with the requirements of the Pennsylvania Department of Environmental Resources or applicable federal laws. The private wastewater system permitting program briefly described under this Article is administered by Patterson Township in strict accordance with the provisions of the Pennsylvania Sewage Facilities Act 537.[1]

At such time as a public wastewater sewer becomes available, as defined in Article IV, § 158-23, to a property served by a private wastewater disposal system, a direct connection shall be made to the wastewater sewer within 90 days of notice, and any septic tanks, cesspools and similar wastewater disposal facilities shall be emptied of waste materials and then filled with suitable materials or completely removed.
The owner shall operate and maintain the private wastewater disposal facilities in a sanitary manner at all times in accordance with its permit and at no expense to Patterson Township. Such facilities shall be subject to inspection by the Sewage Enforcement Officer and DER at reasonable times.
No statement contained in this Article shall be construed to interfere with any additional requirements that may be imposed by the Sewage Enforcement Officer or other applicable authority.
