Contractors shall be divided into the following
classifications, and licenses shall be issued for each classification
upon satisfaction of the application and examination requirements
hereinafter provided.
A. A general building contractor's license shall be issued
to a person, firm or corporation qualified to erect a structure in
its entirety or to add to, alter or repair an existing structure.
A general contractor shall be held accountable for the work of all
separate contractors and subcontractors he employs.
B. A moving contractor's license shall be issued to a
person, firm or corporation qualified and equipped to move any building
or to move the contents of any such building, including personal property
and fixtures.
C. A demolition contractor's license shall be issued
to a person, firm or corporation qualified and equipped to demolish
any structure or portion thereof.
D. An electrician's license shall be issued to a person,
firm or corporation qualified to install, alter or repair electrical
wiring systems and fixtures in a structure.
Applicants for licenses shall be at least 18
years of age, citizens of the United States and shall meet the following
requirements:
A. Applicants for a general building, moving or demolition
contractor's license shall be familiar with building construction
and shall have had at least three years' actual experience in construction
work, either as a superintendent, foreman or as a full-time employee.
B. Applicants for an electrician's license shall have
had at least three years' experience as a full-time employee as an
electrician or electrician's helper.
Licenses may be suspended or revoked for any
one or more of the following acts or omissions:
A. Fraud or misrepresentation in obtaining a license
or a renewal thereof.
B. Violation of this chapter or any other applicable
code, ordinance or statute governing the work performed.
C. Filing of voluntary petition in bankruptcy.
D. Fraud or misrepresentation in obtaining or performing
a contract for the performance of which a license is required under
this chapter.
E. Unjustified failure to perform a contract for the
performance of which a license is required under this chapter.
Any person, firm or corporation aggrieved by
any action of the Board of Examiners taken pursuant to this chapter
shall have the right of appeal to the Council of the Borough of Pen
Argyl. Such appeal shall be taken by filing with the Secretary of
the Borough of Pen Argyl within 10 days after notice of the decision
from which the appeal is taken. The Council of the Borough of Pen
Argyl shall thereafter set a time for hearing the appeal upon at least
10 days' written notice.
Nonresident contractors holding valid licenses
issued by another municipality may obtain a one-time license in the
Borough of Pen Argyl for a specific contract upon application to the
examiners and payment of the fee normally required for the license
for which application is made. Not more than one such license shall
be issued in any one year to a person, firm or corporation.
The fees for the licensing as provided herein
shall be as fixed by the Council of the Borough of Pen Argyl by resolution.
Any person violating any of the provisions of
this chapter shall, upon conviction in a summary proceeding before
a district magistrate, be sentenced to pay a fine of not more than
$300 and the cost of prosecution and, in default of payment of such
fine and cost, to imprisonment in the county jail for not more than
30 days.
