A. 
The owner, occupant or tenant of every property fronting upon or alongside any of the streets or alleys in the Borough of Pen Argyl is hereby required to remove or cause to be removed from all of the sidewalks in front or alongside such property all snow or ice thereon fallen or formed, within 24 hours after the same shall have ceased to fall or to be formed.
B. 
The owner of a property shall be responsible for conforming to the requirements of this section where such property is occupied by such owner or is unoccupied or is a multiple-business or multiple-dwelling property having more than one rental unit; the tenant or occupant shall be responsible where such property is occupied by such tenant or occupant only.
C. 
Deposit of snow. It shall be unlawful for any person to deposit snow or ice in a public street or alley as a result of property owner and/or resident snow removal activities. This includes, but is not limited to, the use of snowblowers or plows to deposit snow in the public street or alley.
D. 
Height of deposited snow. On private or public property, snow and ice may not be piled more than 36 inches higher than street level within 10 feet of an intersection.
E. 
Fire hydrant clearance. Snow and ice shall not be placed on or around a fire hydrant, and the area shall be cleared of snow.
F. 
Placement on neighboring property. Snow and ice shall not be placed onto neighboring property without the express permission of the owner of the real estate upon which the snow is being placed.
G. 
Obstruction in street or along curb. No person shall place or cause to be placed any obstruction or item in the street or along the curb to protect parking area cleared of snow or ice. Such obstructions or items will be removed by the Borough of Pen Argyl and discarded.
H. 
Whenever any person refused to remove any snow or ice, piled, gathered or plowed up by him, or is in violation of this article, within four hours after a request to do so by a representative of the Borough of Pen Argyl, the Borough of Pen Argyl may remove or cause the removal of said snow or ice from such street or terrace at the expense of the violator.
In any case where the owner, occupant or tenant, as aforesaid, shall fail, neglect or refuse to comply with any of the provisions of § 90-36 within the time limit prescribed therein, the Borough of Pen Argyl may proceed immediately to clear all snow and/or ice of any such delinquent, and the Borough of Pen Argyl shall collect the expenses thereof, with any additional amount allowed by law, from such owner, occupant or tenant, as the case may be, which may be in addition to any fine or penalty imposed under § 90-38.

For their first offense, any person violating any of the provisions of this article shall, upon conviction in a summary proceeding before a District Magistrate, be sentenced to pay a fine of $50, together with cost of prosecution, and in default of payment of such fine and cost, to imprisonment in the county jail for not more than 30 days.
B. 
For subsequent offenses, any person violating any of the provisions of this article shall, upon conviction in a summary proceeding before a District Magistrate, be sentenced to pay a fine of not less than $100 nor more than $300, together with cost of prosecution, and in default of payment of such fine and cost, to imprisonment in the county jail for not more than 30 days.
