A. 
Borough officials may designate one parking space in front of an individual's home to be posted and restricted for handicapped parking for that individual (with said parking space extending for a length of at least 20 feet), provided the following conditions have been met:
(1) 
All applications for new and renewal permits shall be submitted to the Pen Argyl Borough Office and be accompanied by a copy of the handicap placard or license plate and a copy of form MV-145A.
(2) 
First time applications for new permits shall be reviewed and investigated by the Public Works Department. The Public Works Department will make a specific recommendation for action on each individual new permit application to Pen Argyl Borough Council. Pen Argyl Borough Council will make the final determination regarding the granting of a handicapped parking space.
(3) 
Each applicant for either a new or renewal permit shall complete an application form and provide all of the information requested in order to be considered by the Public Works Department and Pen Argyl Borough Council.
(4) 
Each new permit for a handicapped parking space must be renewed on an annual basis.
(5) 
Applications for renewal permits shall be submitted to the Pen Argyl Borough Office between January 2 and January 31.
(6) 
Renewals of previously approved permits shall adhere to all criteria contained in this chapter.
(7) 
Once a permit is not renewed for any reason, any application by the same applicant shall be considered as an application for a new permit and shall be governed by all provisions of this policy pertaining to such new permit applications.
(8) 
Permit fees for handicapped parking spaces shall be as fixed by resolution of the Council of the Borough of Pen Argyl. Said fee amount shall be used to cover the Council's cost in purchasing and installing said handicapped parking sign.
(9) 
All fees will be submitted with the application. If the permit is denied, all fees will be refunded.
(10) 
No application for handicapped parking space permits shall be granted where adequate handicap accessible off-street parking is available to the applicant.
(11) 
Pen Argyl Borough Council reserves the right to revoke any handicapped parking space permit at any time for any reason.
B. 
Placards and signs.

(1) 
Upon approval of said handicapped parking place, the Borough of Pen Argyl will issue a placard bearing a number, which placard must be placed in the vehicle to be parked in the handicapped parking space.
(2) 
The Borough of Pen Argyl will also erect a sign designating the handicapped parking space limiting parking in that space to vehicles bearing the placard approved for that space in Subsection B(1).
A. 
Parking of commercial motor vehicles, as that term is defined by the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 1603), and the parking of trailers, semitrailers, truck tractors and combinations as defined by the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 102) is prohibited upon any of the public streets of the Borough of Pen Argyl, except that that section shall not apply to recreational vehicles as defined by Chapter 103, Article VI, § 103-25, of the Code of the Borough of Pen Argyl.
B. 
Notwithstanding the above subsection, such commercial motor vehicles, trailers, semitrailers, truck tractors and combinations may be parked for purposes of picking up or delivering goods, wares, merchandise, people or services to any premises located upon such street, except that in no case shall such vehicle be parked in any one space for more than four consecutive hours.
A. 
No person shall park a vehicle on the public streets of the Borough of Pen Argyl unless that vehicle shall bear a currently valid registration issued by the Commonwealth of Pennsylvania pursuant to Chapter 13 of the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 1301 et seq.), unless said vehicle is exempt from such registration pursuant to § 1302 of the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 1302), or unless said vehicle is currently registered in another state as provided for in § 1303 of the Pennsylvania Motor Vehicle Code (75 Pa.C.S.A. § 1303).
B. 
No person shall park a vehicle on the public streets of the Borough of Pen Argyl unless that vehicle shall bear a currently valid inspection sticker issued pursuant to Chapter 47 of the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 4701 et seq.) or a currently valid inspection sticker issued by another state.
Any person violating or the registered owner of a vehicle found to be in violation of any of the provisions of this article shall, for each and every such violation, upon conviction thereof, be sentenced to pay a fine of $50 and costs of prosecution and, in default of payment of such costs, to imprisonment in the county jail for not more than five days. Anything in the foregoing notwithstanding, any person violating or the registered owner of a vehicle found to be in violation of any of the provisions of this article shall have the right to pay the sum of $10 for each and every violation, provided that such payment of $10 is paid within seven days of the time of the violation, and provided that such payment of $10 is made as specified in the notice of the violation and without the necessity of the Borough seeking a conviction of such violation.
