[Adopted 5-21-1966 by Ord. No. 72-66 as Art. 1701 of the 1966 Code]
A. 
The office of Code Enforcement Official is hereby established, and the executive officer in charge shall be known as the Code Enforcement Officer.
B. 
The Code Enforcement Officer shall be appointed by the Council. His appointment shall continue during good behavior and satisfactory service. He shall not be removed from office except for cause after full opportunity has been given him to be heard on specific charges.
C. 
During the temporary absence or disability of the Code Enforcement Officer, the Mayor shall designate an Acting Code Enforcement Officer.
To be eligible to appointment, the candidate for the position shall have had experience as an architect, structural engineer, building official or superintendent of building construction or experience in building construction. He shall be in good health, physically capable of making the necessary examinations and inspections. He shall have no interest directly or indirectly in the sale or manufacture of any material, process or device entering into or used in connection with building, construction, alteration, removal and demolition.
A. 
The Code Enforcement Officer shall devote his whole time to the duties of his office. He shall receive applications, issue permits and furnish the prescribed certificates as required under the Plumbing, Electrical, Building and Zoning Codes of the City.[1] He shall enforce all the provisions of the Electrical, Plumbing, Building and Zoning Codes of the City. He shall, when requested by proper authority or when the public interest so requires, make investigations in connection with matters referred to in the aforesaid codes and render reports on the same. He shall enforce compliance with such codes to remove illegal or unsafe conditions, to secure the necessary safeguards during construction or to require adequate exit facilities in building and structures. He shall issue such notices or orders as may be necessary.

B. 
The inspections required under the provisions of the aforementioned codes shall be made by the Code Enforcement Officer. The Code Enforcement Officer may accept reports of inspectors of recognized inspection services after an investigation of their qualifications and reliability. No certificate called for by provisions of the aforesaid codes shall be issued on such reports unless the same are in writing and certified to by a responsible officer of such service.
C. 
The Code Enforcement Officer shall keep comprehensive records of applications, of permits issued or certificates issued, of inspections made, of reports rendered and of notices or orders issued. He shall retain on file copies of all required plans and all documents relating to any structure so long as any part of the structure to which they relate may be in existence.
D. 
All records shall be open to public inspection for good and sufficient reason at the office of the Code Enforcement Officer, but shall not be removed from the office of the Code Enforcement Officer without his written consent.
E. 
The Code Enforcement Officer shall make written reports to the Council each month, or more often if requested. Reports should include statements of permits and certificates issued and orders promulgated.
The Code Enforcement Officer, in the discharge of his official duties and upon proper identification, shall have authority to enter any building, structure or premises at any reasonable hour.

A. 
There is hereby created the position of Assistant Code Enforcement Officer for the City of Pottsville.
B. 
It shall be the duties of the Assistant Code Enforcement Officer to receive applications, to issue permits and to furnish certificates and otherwise to enforce the Zoning Codes of the City of Pottsville[1] and perform all other duties as directed by the Mayor.[2]
