As used in this article, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:
CONTAINER
A metal storage receptacle, 10 to 40 cubic yards and not residential or commercial refuse containers, used to temporarily store debris, not to include putrescent, toxic or hazardous waste, and which is then emptied of its contents and removed with its contents to the dump site.
A. 
No persons shall place a container within the City of Pottsville without first obtaining a permit and paying the fee established. The initial fee shall be $5 per container, and may be increased from time to time by resolution of Council which shall be for use in the City. However, in the event that a container is placed in metered parking spaces of City streets, the fee shall be $25 unless the property owner or resident possesses a residential parking permit, at which time the fee shall be $5.
B. 
The permit shall be for a two-week duration if the container is placed upon a City street. If the applicant requires additional time, a second permit may be obtained for up to two weeks and a second permit fee paid. No more than two permits shall be issued by the City for container(s) placed upon City streets. After the expiration of the second permit, the container shall be removed within 24 hours.
C. 
The permit shall be for a six-month duration if it is placed upon private property of the permit applicant.
A. 
The following requirements shall apply to any container(s) placed upon streets in the City:
(1) 
A minimum of eight-inch reflective material shall be placed upon all four sides of the container, each side containing a minimum of four reflectors, to make the container visible at night;
(2) 
Each of the container rollers or wheels (if any) must be placed upon a wood pad at least 3/4 of an inch in thickness so as not to damage the road surfaces in the City;
(3) 
Size of the container will be determined by the contractor or property owner;
(4) 
Once a container is full, the container shall be emptied and/or removed within 24 hours;
(5) 
Each container shall contain in stencil or other visible form, three inches in height, the company name, address and telephone number;
(6) 
No container shall be placed in violation of any traffic rules or regulations enacted by the City of Pottsville and/or Commonwealth of Pennsylvania Department of Transportation, including but not limited to minimum distances from intersections, driveways, etc; and
(7) 
No container shall be placed or removed between the hours of 11:00 p.m and 7:00 a.m.
B. 
Responsibility for permitting rests with the container owner.
C. 
A full or partially full container must be tarped.
At present, Council does not deem it necessary to promulgate any regulations for containers located on private property except that permits be obtained on a six-month basis.
A. 
Any person who shall violate any provision of this article shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 plus costs, and in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days.
B. 
Each day that a violation of this article continues shall constitute a separate offense.
