Upon 30 days' notice from the borough, it shall
be the duty of every owner of real estate abutting upon any street
in the borough now paved and curbed or which may hereafter be paved
and curbed to construct, reconstruct and repair a sidewalk in front
of or alongside such property and thereafter to maintain such sidewalk
in a safe and usable condition. Every such sidewalk shall conform
to all the requirements set forth in this article or adopted in conformity
therewith.
All sidewalks shall be constructed, reconstructed
and repaired of concrete only and according to specifications determined
from time to time by the Borough Engineer, provided that any sidewalk
existing at the time of enactment of this article and having been
lawfully constructed of flagstone may, at the discretion of the owner
of the abutting property, be reconstructed or repaired of flagstone
when reconstruction or repair shall be undertaken.
All sidewalks shall conform strictly to the
line and grade obtained by the property owner from the Borough Engineer,
shall be at least four inches thick and five feet wide and shall be
a uniform distance of 30 inches from the outer line of the curb, such
outer line of the sidewalk to be constructed one inch higher than
the top of the curb, and such sidewalk shall rise 1/4 inch per foot
for the full width of the walk.
Any property owner, upon his own initiative
and without notice from any borough authority, may construct, reconstruct
or repair a sidewalk in front of or alongside his property, provided
that such owner shall first make application to the Borough Engineer
for the line and grade and shall conform to all the requirements of
this article as to line and grade and as to material used.
If any property owner shall, within the time
limit specified herein, fail, neglect or refuse to construct, reconstruct
or repair a sidewalk or, having undertaken any such work, shall fail
to conform to all applicable requirements set forth in this article
or adopted in conformity therewith, the borough shall have the authority
to construct, reconstruct or repair such sidewalk or to complete or
rectify any work undertaken, and the borough shall collect the cost
of such work, with an additional charge of 10% thereof, from such
property owner in any manner authorized by law.
