No person shall ride, operate, coast, or propel himself or anyone else upon any bicycle, tricycle, roller blades, skates, skateboard, scooter, sled or similar device, hereinafter indicated as "device", on any sidewalk or street in the Borough of Indiana, except in accordance with this article.
No person shall ride operate, coast, or propel himself or anyone else upon any of the aforementioned devices on any sidewalk located on Philadelphia Street between 5th and 9th Streets.
Persons shall be permitted to ride, operate, coast, or propel himself or anyone else upon the aforementioned devices on the streets and sidewalks, except where prohibited in § 400-53. Such activities shall be strictly limited to personal conveyance, except that tricycles, skates, roller blades, skateboards, and scooters shall not be operated on the streets. The practice of tricks and/or engagement of competition, without prior approval, shall be prohibited. Persons using any of the aforementioned devices shall be required, at all times, to yield the right-of-way to pedestrians.
No person 10 years of age or under is permitted to use the aforementioned devices on any street when a sidewalk is available, and no person 10 years of age or under is permitted to use such devices on Philadelphia Street between Fifth Street and Ninth Street. Helmets shall be required in accordance with § 400-56.
Vehicle Code provisions for "pedalcycles" (bicycles): All persons operating a bicycle upon the street shall be granted all the rights and shall be subject to all of the duties applicable to drivers of vehicles under the provisions of the Pennsylvania Vehicle Code. Such devices shall not be used to carry more persons at one time than the number for which it is designed and equipped. An adult operator may transport a child in a child carrier, which is securely attached to the device or in a trailer, which is towed. All equipment standards shall be met, including the use of lighting equipment between sunrise and sunset as specified in the Vehicle Code. A person under 12 years of age shall not operate a bicycle or ride as a passenger unless the person is wearing a helmet meeting the standards set forth within the vehicle code. Persons operating any aforementioned device other than a bicycle shall be subject to the provisions set forth within the Vehicle Code pertaining to pedestrians, except as otherwise specified in this article.
No person shall operate a sled upon any street or sidewalk, except that children may be pulled upon a sled by a person over the age of 18. Persons may pull a sled upon a sidewalk in order to get to and from appropriate locations for sled riding.
The provisions of this article shall not apply to privately owned property, except that persons operating such devices on private property shall be subject to applicable statutes including, but not limited to trespassing, vandalism, and disorderly conduct.
Persons violating any section of this article shall, upon conviction thereof, be sentenced to pay a fine of $25 and any costs of prosecution.
