The County Board of Supervisors recognizes that
it is in the best interests of the people of Price County to preclude
the use or purchase of tobacco products by juveniles except in very
limited circumstances.
As used in this article, the following terms
shall have the meanings indicated:
CHILD
A person under 18 years of age.
CIGARETTE
Any roll of tobacco wrapped in paper or any substance other
than tobacco.
LAW ENFORCEMENT OFFICER
Any person employed by the state or any political subdivision
of the state for the purpose of detecting and preventing crime and
enforcing laws or ordinances and who is authorized to make arrests
for violations of the laws or ordinances he is employed to enforce
and includes a person appointed as a conservation warden by the Department
of Natural Resources under § 23.10(1), Wis. Stats.
TOBACCO PRODUCTS
Cigars; cheroots; stogies; periques; granulated, plug cut,
crimp cut, ready-rubbed and other smoking tobacco; snuff; snuff flour;
cavendish; plug and twist tobacco; fine cut and other chewing tobaccos;
shorts; refuse scraps, clippings, cuttings and sweepings of tobacco;
and other kinds and forms of tobacco prepared in such a manner as
to be suitable for chewing or smoking in a pipe or otherwise, or both
for chewing and smoking, but "tobacco products" does not include cigarettes,
as defined under this section.
Except as provided in §
403-34, no child may do any of the following:
A. Buy or attempt to buy any cigarette or tobacco product.
B. Falsely represent his or her age for the purpose of
receiving any cigarette or tobacco product.
C. Possess any cigarette or tobacco product.
A law enforcement officer shall seize any cigarette or tobacco product involved in any violation of §
403-33 committed in his or her presence.
If the court finds that the child violated this
article, it shall enter an order making one or more of the following
dispositions:
A. Counsel the child or the parent or guardian.
B. Impose a forfeiture as provided in Chapter
290 of the County Code plus applicable costs. Any such order shall include a finding that the child alone is financially able to pay and shall allow up to 12 months for the payment. If a child fails to pay the forfeiture, the court may suspend any license issued under Ch. 29, Wis. Stats., or suspend the child's operating privileges as defined in § 340.01(40), Wis. Stats., for not less than 30 days nor more than 90 days. The court shall immediately take possession of the suspended license and forward it to the department which issued the license, together with the notice of suspension clearly stating that the suspension is for failure to pay a forfeiture imposed by the court. It the forfeiture is paid during the period of suspension, the court shall immediately notify the department, which will thereupon return the license to the person.
C. Order the child to participate in a supervised work
program under § 938.34(5g), Wis. Stats.
