This article is adopted pursuant to the authority granted by
and in accordance with the provisions of Village Law §§ 3-300
and 3-301.
As used in this article, the following terms shall have the
meanings indicated:
DEPUTY VILLAGE ATTORNEY
Assistant to the Chief Legal Officer, a Deputy Corporate
Officer of the Village, responsible for Village policy; an attorney
admitted to practice in New York State.
VILLAGE ATTORNEY
The Chief Legal Officer of the Village and a Corporate Officer
of the Village, responsible for decisions involving Village policy;
an attorney admitted to practice in New York State.
The Village Attorney and any Deputy Village Attorneys shall
be appointed by the Mayor, subject to the approval of the Board of
Trustees. The persons so appointed serve at the pleasure of the Mayor.
The Village Attorney and Deputy Village Attorney shall have
the following duties, including but not limited to:
A. Represent the Village in legal matters and proceedings.
B. Research law and render opinions orally and/or in writing when requested
for all departments of the Village.
C. Prepare pleading, appeals, resolutions, notices, contracts and other
legal papers and documents.
D. Examine legal papers served upon the municipality.
E. Appear in Court to represent the Village.
F. Prosecute Village Code violations in the Village Justice Court.
G. Work with the Village Treasurer on tax collection and subsequent
foreclosure proceedings as required.
H. Attend Village Board meetings regularly, and property assessment
grievance hearings, and Justice Court, as required.
I. Such other responsibilities as may be determined by resolution or
local law.
