The movement or transportation of any building from any point
or place to another within the Village or from without the Village
into the Village, the dimensions of which are greater than 10 feet
by 15 feet and 10 feet in height, across or upon the public highways,
streets, avenues and thoroughfares of the Village of Monticello is
hereby prohibited unless the following conditions are met:
A. Such movement is of a building which meets all Monticello Building
Code regulations now in effect.
B. The location to which said building is moved conforms to existing
zoning regulations and the necessary permit has been applied therefor
and issued by the Village Manager.
C. Such movement is made at a time approved by the Chief of Police.
Each application shall be accompanied by a certificate of insurance
in form approved by the Village Attorney and issued by an insurance
company authorized to do business in this state, running to the Village,
guaranteeing that the applicant has provided public liability coverage
of $100,000 and property damage insurance in the amount of $250,000
to save the Village harmless from all claims, actions and proceedings
brought by any person for injury to person or property resulting from
or occasioned by any fault or default by the person to whom the permit
is issued or anyone acting thereunder on his behalf. The policy shall
also protect the Village, in the sum of $10,000, against any damages
caused to any street trees or other public property by reason of such
house moving. In addition, every applicant shall post a ninety-day
completion bond assuring the reerection, modification, alteration
or other work to be done on the building in conformity with the plans
approved by the Village Engineer or his deputy.
The fee for such permit and security deposit shall be as established
from time to time by resolution of the Board of Trustees.
If, in the opinion of the Board, the moving of the structure
seems likely to cause injury to property, trees, electric wires or
otherwise cause hardship or inconvenience, or seems to be not conducive
to public safety or welfare, such permit may be refused, the deposit
fees returned and the bonds canceled.
