It shall be unlawful for any property owner in the Township of Chesterfield to sell and/or transfer title to any real property containing a residential building or structure thereon or lease, let or rent a structure or building to a lessee or tenant for a term in excess of one year without said structure or building containing the requisite number of smoke and fire detectors as required for new construction under applicable state building and fire codes and/or, at a minimum, at least one smoke and fire detector on each floor or story of the structure used as living space.
A. 
It shall be unlawful for any property owner in the Township of Chesterfield to sell and/or transfer title to any real property containing a residential building or structure thereon or lease, let or rent a residential structure or building to a lessee or tenant for a term in excess of one year without first having obtained an inspection from the Burlington County Health Department to ensure compliance with § 162-1 of this chapter and all applicable municipal, county or state sanitary and/or health and/or safety regulations, including regulations pertaining to domestic water supplies and on-site sewerage disposal systems.
B. 
Each property owner in the Township of Chesterfield who plans to sell and/or transfer title to real property or lease or rent a residential building or structure for a term in excess of one year shall notify the Burlington County Health Department within a reasonable time prior to said sale, transfer or rental to arrange for an inspection in accordance with Subsection A above. All repairs and/or modifications required by the Burlington County Health Department to mandate compliance with § 162-1 of this chapter and all applicable municipal, county or state sanitary and/or health and/or safety regulations shall be completed prior to said sale, transfer and/or rental. The property owner shall cause the Burlington County Health Department to reinspect the subject premises subsequent to completion of said repairs and/or modifications to ensure full compliance.
C. 
The property owner shall then procure and obtain a certificate of compliance from the Chesterfield Township Board of Health, which said owner shall transfer and/or present to the purchaser and/or tenant at the time of transfer of title and/or commencement of tenancy.
The Burlington County Health Department and the Township of Chesterfield are hereby authorized to charge a reasonable inspection and certification fee in accordance with the time, efforts and costs involved in completing said inspection and in issuing said certification.

The Chesterfield Township Board of Health and/or the Burlington County Health Department are empowered to administer and enforce the requirements of this chapter.
Any person violating any provision of this chapter shall, upon conviction thereof, be punished by a fine of not more than $500 or imprisonment not exceeding 90 days, or both such fine and imprisonment, in the discretion of the court, and each day such violation shall be continued shall be deemed and taken to be a separate and distinct offense.
