It shall be unlawful for any property owner
in the Township of Chesterfield to sell and/or transfer title to any
real property containing a residential building or structure thereon
or lease, let or rent a structure or building to a lessee or tenant
for a term in excess of one year without said structure or building
containing the requisite number of smoke and fire detectors as required
for new construction under applicable state building and fire codes
and/or, at a minimum, at least one smoke and fire detector on each
floor or story of the structure used as living space.
The Burlington County Health Department and
the Township of Chesterfield are hereby authorized to charge a reasonable
inspection and certification fee in accordance with the time, efforts
and costs involved in completing said inspection and in issuing said
certification.
The Chesterfield Township Board of Health and/or
the Burlington County Health Department are empowered to administer
and enforce the requirements of this chapter.
Any person violating any provision of this chapter
shall, upon conviction thereof, be punished by a fine of not more
than $500 or imprisonment not exceeding 90 days, or both such fine
and imprisonment, in the discretion of the court, and each day such
violation shall be continued shall be deemed and taken to be a separate
and distinct offense.
