As used in this chapter, the following terms
shall have the meanings indicated:
AMUSEMENT CENTER GAMES
Any coin-controlled amusement devices of any description
operated for gain, commonly known as, but not limited to "bagatelle,"
"baseball," "foosball," "Skee-Ball," "ironclaw," "pinball" and "computer
video games." Such definition also includes such games as would be
ordinarily coin-controlled or operated for gain but which are operated
by a system designed to obviate compliance with this chapter. This
definition shall exclude any device possession or use of which is
otherwise prohibited by law and shall also exclude weighing machines
and automatic music devices, such as phonographs, player pianos, jukeboxes
and similar such devices.
[Amended at time of adoption of Code (see Ch. 1, General
Provisions, Art. I)]
No person shall maintain or permit the operation
of an amusement center game without first having obtained a license
for the same as hereinafter provided. The maintenance and operation
of such amusement center game shall be in accordance with the restrictions
of said license.
No person under the age of 16 years shall be
allowed to operate any amusement center game except when such person
shall be supervised by a parent, legal guardian or sibling over the
age of 16 years.
No amusement center game shall be operated by
a person under the age of 18 years without such operation being monitored
by a person who has attained the age of 21 years.
[Amended 9-10-2003 by L.L. No. 2-2003]
The Village Clerk is hereby authorized to issue
a license for amusement center games. The license fee shall be as
set from time to time by resolution of the Village Board of Trustees.
Said license may be transferable to other machines. The license shall
expire on the 30th day of April next succeeding the date of issuance
thereof. Such license shall permit the operation of amusement center
games during the hours of 9:00 a.m. to 9:00 p.m., Sunday through Thursday,
and 9:00 a.m. to 10:00 p.m., Friday and Saturday, except for amusement
center games operated within an establishment regulated pursuant to
the Alcoholic Beverage Control Law of the State of New York for on-premises
consumption, the hours of operation of which shall be controlled by
the provisions of said law for on-premises consumption.
Any person who shall permit an amusement center
game to be operated in violation of the provisions of this chapter
shall be guilty of a violation pursuant to the Penal Law punishable
by a fine not to exceed $250. The continuation of an offense against
the provisions of this chapter shall constitute, for each day the
offense continues, a separate and distinct violation.
