Hereafter any person or persons or corporation desirous of constructing and maintaining in the Borough of Eddystone a gasoline tank or tanks and/or pump or pumps shall make application to the Council of the Borough of Eddystone for permission to construct and maintain the same, and if such permission is granted it will be subject to the terms and conditions of Chapter 143, Fire Prevention, of the Borough of Eddystone.[1]

Such permission shall not become operative until said person, firm or corporation to whom permission has been granted to construct and maintain a tank or tanks and/or pump or pumps has given and executed unto the Borough of Eddystone an agreement accepting the provisions of this article and an agreement to comply with and be bound thereby and a bond with surety to be approved by Council in the sum of $5,000 to indemnify the Borough of Eddystone against any and all damages, loss, costs and expense in the event that a tank with a capacity of more than 1,200 gallons is installed, and any and all claims and demands which may arise or grow out of this article and the construction, maintenance, operation and use of said tank or tanks, inlet pipe and/or pump or pumps and the contents thereof, and the removal of said tank or tanks and/or pump or pumps, which agreement and bond shall be in form satisfactory to the Borough Solicitor. It is the intent of this section that the bond herein required shall apply to all tanks and/or pumps, regardless of their number, installed by the same owner or holder of a permit at one particular location.

Before any work shall be done in constructing or installing any gasoline tank or pump, the sum of $30 shall be paid as a permit fee to the Borough Council for permission to construct and maintain the same.
Any permission granted under this article must be exercised within 30 days from the date of the granting of such permission; otherwise, said permit shall be null and void.
The permission to be granted to any person, firm or corporation under the provisions of this article is to be restricted to such person, firm or corporation and to his, her, their or its executors, administrators or successors and shall not extend to heirs or assigns unless such heirs and assigns shall obtain permission from the Borough Council to continue to maintain the tank or tanks and/or pump or pumps belonging to their decedent or grantor, in which event such heirs and assigns shall accept the provisions of this article in a new agreement and shall furnish a new bond as above provided.

Any person who shall be convicted of a violation of any of the provisions of this article before any District Justice shall be sentenced to pay a fine of not more than $1,000 and costs of prosecution and, in default thereof, to imprisonment in the county jail for a term not to exceed 30 days.
