The following words and terms used in this chapter shall have
the meanings as defined herein:
LOITERER
A person who remains, loiters or wanders in or about a place
without any lawful purpose or object or apparent reason and under
circumstances which justify suspicion that he/she may be or is about
to be engaged in crime, and who, upon inquiry by a police officer,
refuses to identify himself or fails to give a reasonably credible
account of his conduct and purposes; or one who loiters on the street,
sidewalk or other public place and refuses to move on when requested
to do so by any police officer; or one who is lewd, wanton, abusive
or lascivious in speech or behavior.
VAGRANT
A person who has no lawful employment or visible means of
support and who wanders about the Borough at night without apparent
legal reason or purpose and fails or refuses to account for his lawful
presence when requested by a police officer.

Any person who is a vagrant or loiterer, as hereinabove described,
shall, upon conviction thereof before any District Justice, be punished
by a fine of not more than $1,000 or, and in default thereof, by imprisonment
for not more than 30 days. Each day's failure to comply with
any provision of this chapter as aforesaid shall constitute a separate
violation.
