[Amended 6-1-1964 by Ord. No. 389, approved 6-1-1964; 2-17-1975 by Ord. No. 438; 4-11-1977 by Ord. No. 448, approved 4-11-1977; 5-9-1983 by Ord. No. 482, approved 5-9-1983]
All peddlers, hawkers, hucksters, vendors, agents, solicitors, canvassers, salesmen and distributors not engaged in interstate commerce and not acting for a purely public, charitable, religious or educational organization or purpose, for transacting any business in said Borough, shall procure a license so to do from the Borough Secretary and shall pay therefor the sum of $50 for each month or fractional part thereof, and such sums shall be collected by the Secretary prior to the issuance of any license under the provisions of this chapter. Such licenses shall be renewed monthly by the Secretary upon payment of the license fee herein provided.
There shall be no license issued under this chapter for anything that is prohibited by law or other Borough ordinances, nor will the payment of a license fee permit the holder thereof to create or maintain a nuisance or anything of a dangerous character. Licenses granted to individuals are personal, not transferable, and do not permit the employment of unlicensed agents. Each vehicle used for the purposes set forth in this chapter must have a separate license.
[Amended 6-1-1964 by Ord. No. 389, approved 6-1-1964; 2-17-1975 by Ord. No. 438]
All licenses shall be revocable at any time by resolution of the Borough Council, and no license shall be issued to extend beyond one month following the date of issuance.
[Amended 2-17-1975 by Ord. No. 438]
Nothing herein contained shall require the payment of any license fee by farmers selling their own produce or by persons selling goods, wares or merchandise, the proceeds of which are to be applied to a charitable, religious, educational or philanthropic purpose, but all such persons or organizations must nevertheless register with the Borough Secretary and furnish the information as provided in § 218-1 hereof.
[Amended 2-17-1975 by Ord. No. 438; 1-9-1989 by Ord. No. 524, approved 1-9-1989]
Any person who shall be convicted of a violation of any of the provisions of this chapter before any District Justice shall be sentenced to pay a fine of not more than $600 and costs of prosecution and, in default thereof, to imprisonment in the county jail for a term not to exceed 30 days.
