[HISTORY: Adopted by the Board of Trustees of the Village of Middleport 2-15-1994 by L.L. No. 1-1994. Amendments noted where applicable.]
There is hereby established the Tree Board of the Village of Middleport, which shall consist of three members, who are appointed by the Mayor, subject to approval of the Village Board. Members shall serve without compensation, and the Board shall be advisory only. The Board shall perform such duties as conducting tree censuses and generating such reports to the Village Board as it shall deem appropriate from time to time concerning trees in the Village of Middleport.
Members of the Tree Board shall serve for five-year terms, except that the first members shall serve for terms that expire as follows:
A. 
One member: March 31, 1995.
B. 
One member: March 31, 1997.
C. 
One member: March 31, 1999.
Maintenance, planting, trimming, removal and any other activity relating to trees or shrubs within the Village of Middleport which are located with the right-of-way of any street, park or other property owned by the village shall be performed by or under the supervision of the Superintendent of Public Works, subject to review and control of Village Board of Trustees in its discretion.
No private persons shall remove, trim or mutilate any tree or shrub described in § 178-3 above.
Nothing herein shall prevent the usual and necessary trimming of trees by utilities or by the State of New York.
Any person who violates this chapter shall be subject to a fine of not more than $250 or 15 days in jail, or both.
