The words and phrases used in this chapter shall,
for the purpose of this chapter, have the meanings respectively ascribed
to them by Article 1 of the Vehicle and Traffic Law of the State of
New York, and, if no meaning has been so ascribed by said Vehicle
and Traffic Law of the State of New York, then such meaning as has
been ascribed to them by judicial interpretation of the New York State
Courts.
The Board of Trustees and such village official,
including the Superintendent of Public Works of the Village of Middleport,
as said Board of Trustees may from time to time designate, shall install
and maintain traffic control devices when and as required under the
provisions of this chapter to make effective the provisions of said
chapter and may install and maintain such additional traffic control
devices as it may deem necessary to regulate, warn or guide traffic
under the Vehicle and Traffic Law of the State of New York subject
to the provisions of §§ 1682 and 1684 of that law.
On all village streets (other than through highways
under the control of the State Traffic Commission) such traffic control
signals may hereafter be installed as the Board of Trustees of the
Village of Middleport may determine by appropriate resolution to be
advisable and proper, subject, however, to the prior approval whenever
necessary of the State Traffic Commission pursuant to the pertinent
provisions of the Vehicle and Traffic Law of the State of New York.
Subject to the prior approval of the State Traffic
Commission, the Board of Trustees of the Village of Middleport may
hereafter by appropriate resolution designate streets in the Village
of Middleport for one-way traffic.
The Board of Trustees of the Village of Middleport
may hereafter from time to time, by appropriate resolution, subject
to the prior approval of the State Traffic Commission, cause crosswalks
(pedestrian crossings) within the village to be so designated and
appropriately marked.

A. Thirty miles per hour is hereby established as the maximum speed
at which vehicles may proceed within the corporate limits of the Village
of Middleport, except on Telegraph Road.
B. Forty miles per hour is hereby established as the maximum speed at
which vehicles may proceed within the corporate limits of the Village
of Middleport on Telegraph Road.

A. Every person convicted of a traffic infraction for
a violation of any provision of this chapter which is not a violation
of any provision of the Vehicle and Traffic Law of the State of New
York shall, for a first conviction thereof, be punished by a fine
not to exceed $250 and/or imprisonment for up to 15 days, or by both
such fine and imprisonment.
B. Notwithstanding Subsection
A above, a violation of any provision of this chapter relating to parking of motor vehicles shall be a violation which may be enforced by the issuance of a traffic citation form in such form as shall be hereafter prescribed by the Village of Middleport Police Department. A violation of a parking provision shall be punishable by a fine not to exceed $250.
If any part or parts of this chapter are for
any reason held to be invalid, such decision shall not affect the
validity of the remaining portions of this chapter.
A. This chapter shall take effect from and after the
first day of December, 1965, except those parts, if any, which are
subject to approval under § 1684 of the Vehicle and Traffic
Law and § 46 of the Highway Law of the State of New York.
B. Any part or parts of this chapter which are subject
to approval under § 1684 of the Vehicle and Traffic Law
and § 46 of the Highway Law of the State of New York shall
take effect from and after the day on which approval, in writing,
is received from both the New York State Traffic Commission and the
New York State Department of Public Works.
