[HISTORY: Adopted by the Board of Trustees of the Village of Middleport 11-15-1965. Amendments noted where applicable.]
The words and phrases used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York, and, if no meaning has been so ascribed by said Vehicle and Traffic Law of the State of New York, then such meaning as has been ascribed to them by judicial interpretation of the New York State Courts.
The Board of Trustees and such village official, including the Superintendent of Public Works of the Village of Middleport, as said Board of Trustees may from time to time designate, shall install and maintain traffic control devices when and as required under the provisions of this chapter to make effective the provisions of said chapter and may install and maintain such additional traffic control devices as it may deem necessary to regulate, warn or guide traffic under the Vehicle and Traffic Law of the State of New York subject to the provisions of §§ 1682 and 1684 of that law.
On all village streets (other than through highways under the control of the State Traffic Commission) such traffic control signals may hereafter be installed as the Board of Trustees of the Village of Middleport may determine by appropriate resolution to be advisable and proper, subject, however, to the prior approval whenever necessary of the State Traffic Commission pursuant to the pertinent provisions of the Vehicle and Traffic Law of the State of New York.
Subject to the prior approval of the State Traffic Commission, the Board of Trustees of the Village of Middleport may hereafter by appropriate resolution designate streets in the Village of Middleport for one-way traffic.
The Board of Trustees of the Village of Middleport may hereafter from time to time, by appropriate resolution, subject to the prior approval of the State Traffic Commission, cause crosswalks (pedestrian crossings) within the village to be so designated and appropriately marked.
A. 
Through highways.
(1) 
State Street is hereby designated as a through highway, and stop signs shall be erected at the following entrances thereto:
(a) 
All driveways of the Royalton-Hartland Central School (High School and Elementary School) now or hereafter regularly used for exiting from the school property to State Street.
(b) 
Hammond Parkway from the north.
(c) 
East Avenue from the north.
(d) 
Butler Parkway from the north.
(e) 
Alfred Street from the south.
(f) 
William Street from the north.
(g) 
Washington Street from the north.
(h) 
Robertson Street from the north.
(i) 
Maple Avenue from the south.
(j) 
Vernon Street from the south.

(2) 
Main Street between its intersection with State Street and its intersection with Telegraph Road is hereby designated as a through highway, and stop signs shall be erected at the following entrances thereto:

Municipal Parking driveway from the west.
(c) 
Church Street from the west.
(d) 
Park Avenue (Public Common) from the east.

Telegraph Road is hereby designated as a through highway, and stop signs shall be erected at the following entrances thereto:

Kelly Avenue from the north.

Freeman Road/South Main Street from the south.
(c) 
South Main Street from the north.
(d) 
South Vernon Street from the north.

Locust Drive from the south.
B. 
Arterial streets. Vernon Street, Kelly Avenue, Church Street, Park Avenue, North Hartland Street and Main Street north of State Street are hereby designated as arterial streets, and traffic thereon shall have the right of way except that, where any of the above streets intersect each other, the Board of Trustees may, by resolution, cause signs to be erected designating the streets on which traffic shall have the right-of-way.

C. 
Stop intersections at intersections other than with through highways. Stop signs shall be erected at intersections other than those heretofore designated in Subdivision A of § 185-6, as follows:
(1) 
The intersection of Francis Street with Kelly Avenue is hereby designated as a stop intersection, and a stop sign shall be erected on Francis Street at its entrance to said intersection from the east.

The intersection of Kelly Avenue with Church Street is hereby designated as a stop intersection, and a stop sign shall be erected on Kelly Avenue at its entrance to said intersection from the south.

The intersection of Watson Avenue with Centennial Street is hereby designated as a stop intersection, and a stop sign shall be erected on Centennial Street at its entrance to said intersection from the north.
(4) 
The intersection of Jackson Street with Church Street is hereby designated as a stop intersection, and a stop sign shall be erected on Jackson Street at its entrance to said intersection from the south.
(5) 
The intersection of Orchard Street with Church Street is hereby designated as a stop intersection, and a stop sign shall be erected on Orchard Street at its entrance to said intersection from the south.
(6) 
The intersection of Orchard Street with Francis Street is hereby designated as a stop intersection, and a stop sign shall be erected on Orchard Street at its entrance to said intersection from the north.
(7) 
The intersection of South Hartland Street with Church Street is hereby designated as a stop intersection, and a stop sign shall be erected on South Hartland Street at its entrance to said intersection from the north.
(8) 
The intersection of Niagara Street with Vernon Street is hereby designated as a stop intersection, and a stop sign shall be erected on Niagara Street at its entrance to said intersection from the east.
(9) 
The intersection of South Street with Vernon Street is hereby designated as a stop intersection, and a stop sign shall be erected on South Street at its entrance to said intersection from the west.
(10) 
The intersection of Maple Avenue with Vernon Street is hereby designated as a stop intersection, and a stop sign shall be erected on Maple Avenue at its entrance to said intersection from the east.

The intersection of Park Avenue with Vernon Street is hereby designated as a stop intersection, and stop signs shall be erected on Park Avenue at its entrance to said intersection from the east and west.
(12) 
The intersection of Maple Avenue with Park Avenue is hereby designated as a stop intersection, and stop signs shall be erected on Maple Avenue at its entrance to said intersection both from the north and from the south.
(13) 
The intersection of Alfred Street with Park Avenue is hereby designated as a stop intersection, and a stop sign shall be erected on Alfred Street at its entrance to said intersection from the north.
(14) 
The intersection of Mill Street with North Main Street is hereby designated as a stop intersection, and a stop sign shall be erected on Mill Street at its entrance to said intersection from the west.
(15) 
The intersection of Terry Street with North Main Street is hereby designated as a stop intersection, and a stop sign shall be erected on Terry Street at its entrance to said intersection from the west.
(16) 
The intersection of Terry Street with North Hartland Street is hereby designated as a stop intersection, and a stop sign shall be erected on Terry Street at its entrance to said intersection from the east.
(17) 
The intersection of Mechanics Street with North Main Street is hereby designated as a stop intersection, and stop signs shall be erected on Mechanics Street at its entrance to said intersection both from the east and from the west.
(18) 
The intersection of Sleeper Street with North Hartland Street is hereby designated as a stop intersection, and a stop sign shall be erected on Sleeper Street at its entrance to said intersection from the east.
(19) 
The intersection of Sleeper Street with North Main Street is hereby designated as a stop intersection, and a stop sign shall be erected on Sleeper Street at its entrance to said intersection from the west.
(20) 
The intersection of Sherman Road with North Hartland Street is hereby designated as a stop intersection, and a stop sign shall be erected on Sherman Road at its entrance to said intersection from the west.

The intersection of North Hartland Street with Mill Street is hereby designated as a stop intersection, and a stop sign shall be erected on North Hartland Street at its entrance to said intersection from the south.

A. 
Thirty miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village of Middleport, except on Telegraph Road.
B. 
Forty miles per hour is hereby established as the maximum speed at which vehicles may proceed within the corporate limits of the Village of Middleport on Telegraph Road.
A. 
Parallel parking. Except where angle parking is authorized, every vehicle stopped, standing or parked upon a highway where there are no adjacent curbs shall be so stopped, standing or parked parallel with the edge of the roadway headed in the direction of lawful traffic.
B. 
All-night parking. The parking of vehicles is hereby prohibited on all highways within this Village between the hours of 3:00 a.m. and 6:00 a.m. from November 1 of any year to April 30 of the year immediately following.

C. 
Parking prohibited in designated locations. The parking of vehicles is hereby prohibited in any of the following locations:
(1) 
On the south side of Park Avenue between the east curbline of Vernon Street and the west curbline of Alfred Street; and on the south side of Park Avenue between Vernon Street and Main Street from a point 100 feet east of the east curbline of Main Street.
(2) 
On the east side of Maple Avenue between the south curbline of State Street and the north curbline of Freeman Avenue.
(3) 
On the south side of Freeman Avenue between the east curbline of Alfred Street and the west curbline of Maple Avenue.
(4) 
On the west side of Vernon Street between the south curbline of State Street and a point 300 feet south therefrom.

No vehicle shall be parked on State Street between Vernon Street as extended and Main Street or on Main Street between Church Street or Park Avenue and the Erie Barge Canal for a period in excess of two hours.

No vehicles shall be parked on either side of North Main Street between the intersection of North Main Street and Mechanic Street, and the New York State Barge Canal Bridge on Main Street.

No vehicle shall be parked on any highway, roadway, or place designated by appropriate markers as no-parking or restricted parking by the Village, State, County, or any other governmental entity.

D. 
Limited parking.

(1) 
No vehicles, other than registered motor vehicles of disabled persons pursuant to Vehicle and Traffic Law § 404-a or vehicles displaying parking permits for disabled persons pursuant to § 1203-a, shall be parked in the following location:
(a) 
On the west side of Vernon Street between a point 25 feet north of the north curbline of Park Avenue and the west curbline of Vernon Street and a point 70 feet north of the intersection of the north curbline of Park Avenue and the west curbline of Vernon Street (two spaces).
(b) 
On the west side of Main Street between a point 135 feet south of State Street to a point 20 feet south thereof.[2]

E. 
Future parking regulations to be by resolution. On all Village streets, parking rules and restrictions may hereafter be enacted and repealed by the Village Board of Trustees of the Village of Middleport by resolution, subject, however, to the pertinent provisions of the Vehicle and Traffic Law of the State of New York. Upon posting of identifying signage, any such rule or regulation shall be punishable in the same manner as a regulation within this chapter.

A. 
Trucks in excess of 10,000 pounds and other commercial vehicles in excess of such total gross weight, including tractor-trailer combinations, tractor-semitrailer combinations, or tractor-trailer semitrailer combinations, shall be and hereby are excluded from and prohibited from traveling over Watson Avenue, Church Street, and Orchard Street.

B. 
Notwithstanding Subsection A, above, a violation of any provision of this chapter relating to parking of motor vehicles shall be a violation which may be enforced by the issuance of a traffic citation form in such form as shall be hereafter prescribed by the Village of Middleport Police Department. A violation of a parking provision shall be punishable by a fine of $15, except that if said fine is not paid within 10 days from the date of the violation, the fine shall be $25, and if not thereafter paid, shall be a violation as set forth in § 185-10A above, and the penalties set forth therein shall also apply to parking violations.

C. 
This exclusion shall not be construed to prevent the delivery or pick up of merchandise or other property along such street, provided that other streets shall be utilized where access to said property is available, or to prohibit the utilization of said street by fire and emergency vehicles.

A. 
Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine not to exceed $250 and/or imprisonment for up to 15 days, or by both such fine and imprisonment.
B. 
Notwithstanding Subsection A above, a violation of any provision of this chapter relating to parking of motor vehicles shall be a violation which may be enforced by the issuance of a traffic citation form in such form as shall be hereafter prescribed by the Village of Middleport Police Department. A violation of a parking provision shall be punishable by a fine not to exceed $250.
If any part or parts of this chapter are for any reason held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.
A. 
This chapter shall take effect from and after the first day of December, 1965, except those parts, if any, which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York.
B. 
Any part or parts of this chapter which are subject to approval under § 1684 of the Vehicle and Traffic Law and § 46 of the Highway Law of the State of New York shall take effect from and after the day on which approval, in writing, is received from both the New York State Traffic Commission and the New York State Department of Public Works.
