A. 
Definitions. The following words, when used in this Part 2, shall have the meanings ascribed to them in this section, except in those instances where the context clearly indicates otherwise:
APPLICANT
Any person making application for a road opening permit.

BACKFILL
An aggregate material composed of materials approved by the Borough and specified by the Pennsylvania Department of Transportation, Publication 408.

BOROUGH
The Borough of East Stroudsburg, County of Monroe, Commonwealth of Pennsylvania.
BOROUGH MANAGER
The person in charge of Borough affairs, including the Department of Public Works and road maintenance operations in the Borough, or his authorized designee, representative or inspector.

COST
All expenditures incurred by the Borough for labor, equipment and materials.

EMERGENCY
Any unforeseen circumstance or occurrence, the existence of which constitutes a clear and immediate danger to persons or properties.
EXCAVATION
Any ditch, trench, tunnel, saw cut, test or vent hole, boring, or opening in or under the surface of any street in the Borough.

INSPECTION
A site visit by the Borough Manager or designee to verify compliance with the provisions of this chapter.

INSPECTION FEE
The fee paid by the permittee to the Borough for special inspections of road repaving work required by this chapter.

MUNICIPAL AUTHORITY
Any body corporate and politic created pursuant to the laws of the Commonwealth of Pennsylvania.
PA ONE CALL
The agency responsible for coordinating the notification of all utilities of an impending street excavation.

PERMIT FEE
The fee paid by the permittee to the Borough for regular inspections and for the administration of this chapter.

PERMITTEE
Any person who has been issued a permit and who is responsible for fulfilling the requirements of Part 2 of this chapter.

PERSON
Includes any natural person, partnership, firm, association, utility, corporation or authority created pursuant to an act of the Pennsylvania General Assembly. Whenever used in any section prescribing and imposing a penalty, the term "person," as applied to associations, shall mean the partners or members thereof and, as applied to corporations, the officers thereof.
PUBLIC UTILITY COMPANY
Any company subject to the jurisdiction of, and control by, the Pennsylvania Public Utility Commission.
RESTORATION FEE
The fee paid by the permittee to the Borough as a security deposit to assure the street excavation is repaired in accordance with the provisions of this chapter.

RIGHT-OF-WAY
The legal right-of-way of any street in the Borough.

SIDEWALK
That portion of the street right-of-way reserved for pedestrian traffic.

STREET
Includes any public street or road, public alley, public easement, or public right-of-way owned or maintained by the Borough, or in which the Borough maintains utilities within the Borough limits, and shall mean the entire right-of-way of same.

WORK ZONE SAFETY
Implementing appropriate traffic control measures and the posting of appropriate work area warning signs to provide for the safety and welfare of the public and construction crews. Work zone safety shall conform to the Pennsylvania Department of Transportation Publication 203, Work Zone Traffic Control.

B. 
Usage. In this Part 2, the singular shall include the plural, and the masculine shall include the feminine and the neuter.
