When the Borough intends to pave or improve any street, the Borough shall give notice to all public utilities and municipal authorities operating in the Borough, and all such public utilities and municipal authorities shall make all connections and any needed repairs to their facilities which would require excavation of the street within 60 days from the giving of such notice by the Borough. The time may be extended if permission is requested in writing and approved by the Borough Manager after consultation with the Borough Engineer.
No permit shall be issued by the Borough Manager which would allow an excavation or opening in a paved and improved street surface less than five years old unless the applicant can clearly demonstrate that public health or safety require that the proposed work be permitted or unless an emergency condition exists.
A. 
If the applicant opens pavement having a bituminous concrete surface, the applicant shall, in addition to restoring the pavement opening according to the requirements of § 136-17, mill and overlay the pavement in accordance with the conditions below, based on the following pavement classifications:
(1) 
Pavement classification A: wearing course less than five years old.
(2) 
Pavement classification B: wearing course is between five and 10 years old.
(3) 
Pavement classification C: wearing course is older than 10 years old.
B. 
When a longitudinal opening has been made in the pavement for the specified length in linear feet of pavement indicated below, the applicant shall mill and overlay the traffic lane in which the opening was made for the entire length of the opening:
(1) 
Pavement classification A: longer than 50 linear feet.
(2) 
Pavement classification B: longer than 100 linear feet
(3) 
Pavement classification C: longer than 100 linear feet.
C. 
When two or more transverse openings have been made by the same applicant within the specified linear feet of pavement indicated below, the applicant shall mill and overlay the traffic lanes in which the openings were made for the entire length of the street between the openings:
(1) 
Pavement classification A: within 100 linear feet of pavement.
(2) 
Pavement classification B: within 50 linear feet of pavement.
(3) 
Pavement classification C: within 25 linear feet of pavement.
D. 
When four or more emergency openings have been made by the same applicant within the specified linear feet of pavement indicated below, the applicant shall mill and overlay traffic lane(s) in which the openings were made for the entire length of the street between the openings:
(1) 
Pavement classification A: within 100 linear feet of pavement.
(2) 
Pavement classification B: within 100 linear feet of pavement.
(3) 
Pavement classification C: within 50 linear feet of pavement.
E. 
When a pavement opening area is greater than the specified percentage indicated below of the pavement area from the edge of pavement to the center line of the street, the applicant shall mill and overlay the entire width of the traffic lane in which the opening was made for the entire length of the opening:
(1) 
Pavement classification A: greater than 25%.
(2) 
Pavement classification B: greater than 50%.
(3) 
Pavement classification C: greater than 50%.
F. 
When a pavement opening is within three feet of the edge of the pavement, the applicant shall mill and overlay from the opening out to the edge of pavement for the entire length of the opening.
G. 
Applicant shall refer to the repair detail for each pavement classification attached to this chapter and incorporated herein by reference.[1]
