It shall be unlawful for any person 15 years of age and under to be
or remain in or upon any public streets, alleys or public commons in the Borough
at night after the hour of 11:00 p.m., unless such person is accompanied by
a parent, guardian or other person having the legal custody of such minor
person, or such minor person is in performance of an errand or duty directed
by such parent, guardian or other person having the care or custody of such
minor person or whose employment makes it necessary to be upon such streets,
alleys or public commons during the nighttime after specific hours; provided
that this exception shall not apply when the person under age shall be playing
or unnecessarily loitering in or upon said streets, alleys or public commons,
whether alone or accompanied by a parent, guardian or any other person or
persons whomsoever.
It shall be unlawful for any parent, guardian or other person having legal care or custody of any person 15 years of age and under to allow or permit any such child, ward or other person under such age, while in such legal custody, to go or be in or upon any of the streets, alleys or public commons in the Borough with the time prohibited in §
9A-1, unless reasonable necessity exists therefor.
The police department is hereby authorized to arrest, without warrant, any person willfully violating §
9A-2 and detain such person for a reasonable time in which a complaint can be made and a warrant served.
Any person violating the provisions of this chapter shall be punished
according to the following:
A. First through third offense: a fine of $25 for the parents
if they refuse to pick up the child; no fine if the child is picked up.
B. Upon parents' refusal to pick up, a police officer will
take the child home and his or her name will be given to the Bridge Youth
Services for counseling.
C. After fourth offense: a fine of $100 for the parents,
and the child will be committed to the juvenile detention center.
