For the purposes of this article, the following words and terms shall be deemed to have the meanings set forth herein:
ASHES
Residue, coals and clinkers from a furnace, fireplace or stove.
GARBAGE
All waste, animal, fish, fowl, fruit or vegetable matter resulting from the use and storage of food for human consumption.
GARBAGE CANS, RECEPTACLES OR CONTAINERS
Any metallic or plastic container or containers of like composition with a proper cover.
GARDEN REFUSE
Grass clippings, weeds, shrubbery, shrub clippings, leaves and like materials generated by normal maintenance of lawn, garden and grounds.
PERSON
Any person, partnership, corporation or association of persons.
RUBBISH
All wooden boxes, appliances, furnishings, household, industrial and commercial equipment and any other material which is not constituted as garbage, trash and garden refuse, but excluding rocks, soil and building and construction materials which by bulk or weight exceed the limitations of containers used for trash.
TRASH
All glassware, bric-a-brac, household utensils, house sweepings, old clothing, cardboard and like materials generated by the normal maintenance of household industrial and commercial uses, not subject to recycling under the terms of Article II, as amended.

A. 
All garbage is to be stored and collected from watertight, covered containers which shall not be filled to a level higher than three inches below the top thereof.
B. 
All trash, garden refuse and ashes are to be stored and collected from covered containers. Plastic bags may be used, provided that they are durable and meet manufacturer's specifications as garbage bags, and such bags must be sealed.
C. 
Cans, receptacles or containers shall be supplied and maintained by each householder or industrial or commercial facility and must be kept tightly covered at all times to prevent the scattering of the contents thereof over abutting roads or properties.

No person shall bring in, place or deposit or cause to be brought into, placed or deposited in the borough any garbage, refuse, trash, paper, hazardous waste and/or material or ashes originating outside the borough for the purpose of disposing of the same in the borough or for the purpose of having the same collected by the borough or by a solid waste collector operating in the borough.

No person who is a resident of the borough or owner, lessee or person in control of real property within the borough shall permit any person to bring in, place or deposit garbage, refuse, trash, paper, hazardous waste and/or material or ashes originating outside the borough on any real property owned or leased by him or her or under his or her control.

Any person who shall violate any of the provisions of this article or any order promulgated hereunder shall, upon conviction, be subject to a fine not exceeding $1,000, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof, and each violation of any of the provisions of this article and each day that such violation shall continue shall be deemed to be a separate and distinct offense.

As used in this article, the following terms shall have the meanings indicated:
ALUMINUM CANS
Recyclable aluminum cans. Does not include pie plates, ferrous metals or other metal by-products.
CONSTRUCTION AND DEMOLITION DEBRIS
Source-separated nonputrescible recyclable material generated from the construction, alteration, repair, maintenance and/or demolition of structures within Bergen County. This material shall include concrete, bricks, block, ferrous and nonferrous scrap, asphalt, asphalt shingles, recyclable wood scrap and any and all other material generated from the construction, alteration, repair, maintenance and/or demolition of a structure or structures within Bergen County that a municipality may deem recyclable.

CORRUGATED PAPER
Structural material shaped in parallel furrows and ridges for rigidity, used to make packing and shipping containers primarily for commercial/industrial operations.
FERROUS SCRAP
Products made of metal exclusive of aluminum, excluding washers, dryers, refrigerators, water heaters, tire rims, bicycles and scrap metal.

GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for packaging or bottling of various matter, and all other materials commonly known as "glass," excluding, however, blue and flat glass commonly known as "window glass."
GLASS BEVERAGE CONTAINERS
All glass containers used for packaging beverages.

GRASS
Green herbage sending up spike-like shoots or blades.

HIGH-GRADE OFFICE PAPER
Paper used in offices, such as computer paper, white typing ledger paper, white notepad paper, copier paper, computer printout paper and manila tab cards.
HOUSEHOLD-GENERATED BATTERIES
Any type of button, coin, cylindrical, rectangular or other shaped, enclosed device or sealed container consisting of a combination of two or more voltaic or galvanic cells, electrically connected to produce electric energy, composed of lead, lithium, manganese, mercury, mercuric oxide, silver oxide, cadmium, zinc, copper or other metals, or any combination thereof, and designed for household use, including any alkaline, manganese, lithium, mercuric oxide, silver oxide, zinc-air or zinc-carbon battery, nickel-cadmium rechargeable battery or sealed lead rechargeable battery.

LEAVES
Those materials naturally formed from trees and shrubs that are suitable for composting and mulching purposes.
MIXED PAPER
Source-separated mixture of all types of paper, including but not limited to corrugated, high-grade paper, newspaper, magazines, telephone directories, wrapping paper, boxboard, books, grocery bags and junk mail.

NEWSPAPER
Paper of the type commonly referred to as "newsprint" and distributed at stated intervals usually daily or weekly, having printed thereon news and opinions and containing advertisements and other matters of public interest. Magazines and periodicals as well as any other paper products are not considered newspaper.
SOLID WASTE
Includes all garbage and rubbish usually disposed of by regular scavenger service for the residential and nonresidential occupants of the Borough of Teterboro.
TIN CANS (FERROUS CONTAINERS)
Cans made of steel or tin. The most common are tin-plated steel cans which contain food.

TYPE 1 AND 2 PLASTIC CONTAINERS
Containers such as polyethylene terephthalate (PETE-1), soda bottles, high-density polyethylene (HDPE-2), milk, water or detergent bottles.

WHITE GOODS
Used appliances, such as refrigerators, washers, dryers and stoves.

A. 
On and after the date fixed and promulgated by regulations issued as hereinafter provided and in accordance with the terms hereof, it shall be mandatory for all residential, commercial/industrial and institutional facilities to separate the recyclable materials designated in § 153-8 hereof from all other solid waste produced by any such facilities and to separately bundle such materials for pickup and collection for recycling, in accordance with regulations hereinafter set forth.

B. 
It is anticipated that most of the commercial/industrial and institutional facilities in the Borough of Teterboro will elect to file an exemption request form, in which event such facilities shall be obligated to comply only with those provisions hereof pertaining to recyclable materials and the separation thereof, but shall not be obligated by the collection requirements of this article. The borough will not supply containers to the commercial/industrial and institutional facilities.

A. 
Separation and placing for removal; containers. The owner or occupant of any building, residential, commercial/industrial or institutional, within the Borough of Teterboro who shall place for disposal, removal or collection the following items shall do so in strict conformity within the following regulations:
(1) 
Aluminum cans shall be placed in containers supplied by the borough and placed at curbside for pickup in accordance with a schedule as authorized herein.

(2) 
Glass and glass containers, as defined herein, shall be separated into clear, brown and green glass and contained in Borough-supplied containers and placed at curbside for pickup in accordance with the schedule as authorized herein.

(3) 
Corrugated paper shall be collected for recycling purposes by industrial/commercial facilities which are exempt from regulatory provisions of this article by reason of filing with the borough an exemption request form and acceptance thereof.
(4) 
Newspapers shall be bundled separately, secured by cord, the bundles not to exceed 50 pounds in weight. Newspapers shall not be bundled in plastic bags. No magazines shall be mixed with newspapers. Newspapers shall be collected at curbside in accordance with the schedule as authorized herein.
(5) 
High-grade office paper shall be collected for recycling purposes by industrial/commercial facilities which are exempt from regulatory provisions of this article by reason of filing with the borough an exemption request form and the acceptance thereof. If other than an industrial/commercial/institutional facility, then such paper shall be placed in plastic bags in quantities not to exceed 50 pounds in weight and placed at curbside for collection in accordance with schedules as authorized herein.
(6) 
Leaves. Between January l and December 31 of each year, leaves, unless stored or recycled for composting or mulching or voluntarily delivered to a composting area, shall be placed at curbside in plastic bags for pickup in accordance with a schedule as authorized herein. Under no circumstances shall leaves be placed for collection or disposal as solid waste.

(7) 
Ferrous scrap. To be collected for recycling purposes by industrial/commercial/institutional facilities which are exempt from regulatory provisions of this article by filing with the borough an exemption request. Other than industrial/commercial/institutional facilities, such ferrous scrap shall be placed into containers as referred to herein or, if in no container, placed at curbside for collection in accordance with schedules as authorized herein.

(8) 
White goods shall be placed at curbside for pickup in accordance with the schedule as authorized herein.

(9) 
Tin cans shall be placed in containers supplied by the borough and placed at curbside for pickup in accordance with the schedule as authorized herein.

(10) 
Grass. Grass shall be placed at curbside in plastic bags for pickup in accordance with the schedule as authorized herein.

(11) 
Mixed paper. Mixed paper shall be collected for recycling purposes by industrial/commercial facilities which are exempt from regulatory provisions of this article by reason of filing with the borough an exemption request form and acceptance thereof.

(12) 
Construction and demolition debris shall be collected for recycling purposes by industrial/commercial facilities which are exempt from regulatory provisions of this article by reason of filing with the borough an exemption request form and acceptance thereof.

(13) 
Household-generated batteries shall be placed in containers supplied by the borough and placed at curbside for pickup in accordance with the schedule as authorized herein.

(14) 
Type 1 and 2 plastic containers shall be placed at curbside by residential owners or occupants for pickup by the DPW in accordance with the schedule as authorized herein. Industrial/commercial owners or occupants may deliver Type 1 or Type 2 plastic containers to the Teterboro DPW or may dispose of same independently in accordance with the regulations and schedule as authorized herein.

B. 
The containers referred to herein to be supplied by the borough shall not exceed a ten-gallon capacity and shall not be supplied to the commercial/industrial and institutional facilities.
C. 
Commercial, industrial and institutional facilities can obtain exemption from the regulatory provisions hereof by filing an exemption request form with the borough, acceptance thereof by the borough and the filing with the borough a registration and semiannual report form setting forth the quantities and type of materials recycled.

From the time of placement at curbside for delivery to a depot by and on behalf of any residential facility, all recyclable materials shall become the property of the Borough of Teterboro or its authorized agent. It shall be a violation of this article for any unauthorized person to collect, pick up, deliver or cause to be collected, picked up or delivered any such recyclable materials. Any such collection, pickup or delivery in violation of this article shall constitute a separate and distinct offense punishable as hereinafter provided.
A. 
Anything herein to the contrary notwithstanding, any person who is an owner, lessee or occupant may donate or sell recyclables to any person, partnership or corporation, whether operating for profit or not for profit. All industrial, commercial and institutional facilities electing to file with the borough a form of Request for Exemption shall be exempt from the collection regulations of § 153-8 hereof but shall be required to separate and remove such classified materials for recycling purposes.
B. 
The borough is hereby authorized to contract with a recycling service for the purchase of recyclables collected by or on behalf of the borough. Any such contracts shall be in writing and subject to approval by resolution of the Borough Council.

The Recycling Coordinator, the Construction Code Official and the Police Department are hereby authorized and directed to enforce this article. The Borough Clerk is hereby authorized and directed to establish and promulgate rules and regulations as to the manner, days and times for collection or delivery of recyclable materials as defined herein and initially, in accordance with the terms hereof. Such regulations shall be promulgated no later than three months from the date hereof. Within 30 days from the date of the promulgation and publication of said regulations, the Borough Council may, by resolution, change, modify, repeal or amend any portion of said rules and regulations.

Any person, firm or corporation who violates or neglects to comply with any provision of this article or any regulation promulgated pursuant thereto shall, upon conviction thereof, be subject to a fine not exceeding $1,000, a term of imprisonment not exceeding 90 days or a period of community service not exceeding 90 days, or any combination thereof. No enforcement of §§ 153-7 and 153-8 shall be made until six months from the effective date of regulations authorized to be promulgated hereunder. A maximum of two warning notices shall be issued before the issuance of a Summons and Complaint for all violations hereunder.
