The purpose of this chapter is to provide a consolidated schedule of fees to be charged in the administration of Village laws, ordinances, regulations and resolutions and to permit an annual review and modification of such fees by the Village Board.
The fees set forth herein shall apply to the provisions of all of the local laws, ordinances, regulations and resolutions of the Village of Woodbury adopted prior to the date of this chapter and shall supersede any specific fee contained or referred to therein.
The schedule of fees of the Village of Woodbury shall be as follows:
A. 
Application to the Zoning Board of Appeals, Planning Board and Board of Trustees.
(1) 
Zoning Board of Appeals fees.
(a) 
Special permit: $150.
(b) 
Residential area variance: $250.
(c) 
Residential use variance: $250.
(d) 
Commercial area variance: $500.
(e) 
Commercial use variance: $750.
(f) 
ZBA interpretation of code: $250.
(g) 
Review of ruling by Code Enforcement Officer: $250.
(2) 
Planning Board fees.
(a) 
Special permit, new and renewal: $75.
(b) 
Site plan: $75.
(c) 
Subdivision: $75.
(3) 
Board of Trustees.
(a) 
Special permit: $75.
(4) 
Subdivisions, minor and major, excluding planned unit development.
(a) 
Minor: $100.
(b) 
Major.

Sketch plan approval: $25 per lot.
[2] 
Preliminary approval: $50 per lot.
[3] 
Final approval: $25 per lot. This sum shall be refunded by the Village if the Planning Board determines that such amount is not required.
(5) 
Site plan approval.
(a) 
Existing structures or additions to existing structures: $100.
(b) 
New development, business or industrial structures: $500.
(c) 
Mobile home court (per mobile home, per application and/or renewal of special permit): $75.
(6) 
Site plan and subdivision inspection escrow fee: not less than 4% nor greater than 6% of the amount of the value of construction, which amount is to be estimated by the Village Engineer, to help defray costs of observing the work to provide better assurance to the Village that it is in accordance with the approved plans for the construction of roads, water systems, sewer systems and other utilities in the development.
B. 
Application to Building Department.
(1) 
Fees.
(a) 
Floodplain letter: $20 per letter.
(b) 
Building permit: fees pursuant to resolution adopted by Village Board of Trustees.
(c) 
Certificate of occupancy or copies: $25.
(d) 
Amendment to building permit: $30.
(e) 
Extension of building permit: $5 per month.
(f) 
Fire permit: $50, except there shall be no fire permit fee required for any events sponsored by the Village or Town of Woodbury.
(g) 
Blasting permit: $100.
(h) 
Bungalow permit: $10 per unit.
(i) 
Floodplain development permit: fees pursuant to resolution adopted by the Village Board of Trustees.

(j) 
Fireworks permit: $250, except the Village Board of Trustees may waive the fee required for any events sponsored by the Town or Village of Woodbury.

Municipal search: $100.

C. 
Special consultants' fees.
(1) 
The Village Board, Planning Board and Board of Appeals, in the review of any application described above or in reviewing any other application which is presented to any of the Boards whereby consultants are to be retained to advise such Boards, may refer any such application presented to it to such engineering, planning, legal, technical, environmental, wetlands, wireless communications facilities or other consultant as such Board shall deem necessary to enable it to review such application as required by law. The amount of the fee shall be determined pursuant to the provisions of Subsection C(3).
(2) 
Escrow. The applicant shall deposit with the Village Clerk an escrow to cover the costs to be incurred by the Village for the aforesaid consulting services or other special retained expert in connection with applications before the respective Boards.
(3) 
Planning Board amount of escrow. The Woodbury Building Department shall compute the initial escrow charge in accordance with the following schedule:

Subdivisions.

Residential: $2,500.

New structure or use: $5,000 per acre and $0.50 per square foot of structure.

Existing structure or use: $3,500 per acre and $0.50 per square foot of structure.
(c) 
Informal work session appearance: $500.

(d) 
Architectural Review Board appearance.

Residential: $500 per lot.
[2] 
Commercial: $3,500 per lot.
(e) 
Other nonlisted matters. In any and all matters that the consultants are requested to review and advise the aforesaid Boards, the fees that are charged by such consultants shall be determined, where possible, in advance, and the individual applicant shall be required to deposit moneys into the escrow account pursuant to this Subsection C.
(f) 
Retaining of other consultants. If necessary, where other special consultants are to be retained, the consulting engineer and/or consulting planner shall refer that portion of the application to the outside consultants for determination of the amount of their fees. After the consulting engineer and/or consulting planner have determined the amount of the escrow for the aforesaid consulting services, they shall notify the Building Department of the additional escrow requirement. The application will not be listed for any meetings or hearings before the respective Boards until all fees, including the escrow, are paid.
(4) 
Replacement of escrow account. If the escrow account falls below 20% of the initial deposit, the Building Department may, if recommended by the consulting engineer and the consulting planner, require that the applicant pay additional funds into the escrow account up to 50% of the initial deposit.
(5) 
Reimbursement of escrow. In the event that an applicant shall withdraw his or her application at any stage of the proceedings or when the application review and approval process has been completed, the excess funds in the applicant's account, if any, either shall be remitted to the applicant or, if so directed by the applicant, shall remain on deposit as the applicant's initial payment toward the postapproval inspection requirements.
(6) 
Deficiency of account. The application shall be responsible for all of the foregoing fees, notwithstanding that the escrow account might be insufficient for said fees or expenses.
(7) 
Review of application. Until the escrow account and all fees, as set forth herein, are paid, no review of an application shall be undertaken by the consultants. The failure to replenish the escrow account as required or the failure to pay the fees as required herein shall be appropriate grounds for the denial of an application. The matter shall not be scheduled before a particular board, except for the issuance of a denial as provided herein.

D. 
Water and sewer consultant fees and inspection fees.
(1) 
Where the Water and Sewer Department is required to review plans and specifications for buildings not located within subdivisions or site plans approved by the Woodbury Planning Board, the Superintendent of the Water and Sewer Department may refer the plans and specifications to such engineering, legal, technical, environmental or other consultants as the Superintendent of the Water and Sewer Department shall deem necessary to enable the Department to review such plans and specifications. The owner or the contractor shall be required to deposit a sum of money for the amount of the consultant's fees, which sum shall include the time required by the Water and Sewer Department to inspect the water and sewer facilities for the project.
(2) 
Escrow. The owner or contractor for whose property such facilities are to be provided shall deposit with the Village Clerk an escrow to cover the costs to be incurred by the Water and Sewer Department for consulting services and services to be provided by the Water and Sewer Department in connection with reviewing the plans and specifications and making the required inspections for the site.
(3) 
Amount of escrow. The Woodbury Water and Sewer Department or the Village's consulting engineer shall compute the initial escrow charge, the amount of which shall be given to the property owner or contractor who shall within 10 days deposit said sum for the consulting and inspection fees. If additional fees are required beyond the original estimate to complete the required review and inspection, such fees shall be estimated as soon as the deficiency is discovered and the new amount billed to the property owner or contractor with payment required within 10 days.
(4) 
Review of plans and specifications and inspections. No review of plans and specifications or inspections of water and sewer facilities shall be undertaken by the Water and Sewer Department or its consultants until the escrow account has been established and all fees have been paid.
(5) 
Inspection fees:
(a) 
Single-family residences: $300 for a water service line inspection and $300 for a house sewer lateral inspection.
(b) 
Commercial uses (not within a shopping mall or a business park): $400 for a water line connection and $400 for a sewer line connection.
E. 
Freshwater wetlands. All expenses incurred by the Village's boards shall be reimbursed prior to the issuance of a permit.
F. 
Testing water meters. The fee for testing water meters pursuant to § 298-11A shall be $75.

The Village Board, by resolution, may from time to time modify the fees imposed under § 143-3B of this Code, and the resolution shall be on file in the office of the Village Clerk and the Building Department.
