Prior to the completion of the infrastructure
in a subdivision, a developer shall be permitted to construct model
homes within such subdivisions, provided that they have complied with
the following:
A. Number of models. The total number of model homes
shall not exceed 5% of the total number of lots within such subdivision.
B. Prior conditions. In order to secure building permits
for model homes, the following shall be completed:
(1) The subdivision must have final subdivision approval
from the Woodbury Planning Board, and such map must be signed by the
Chairman and filed in the Orange County Clerk's office.
(2) All fees, including parkland fees, shall have been
paid.
(3) A building permit for site work improvements shall
have been issued.
(4) All other requirements of the Code Enforcement Officer
(i.e., building plans, application, fees, etc.) shall be met.
C. Improvements; certificate of occupancy. Prior to the
issuance of a certificate of occupancy for model homes, the following
infrastructure improvements must be completed:
(1) The road giving access to the model homes shall be
graded and New York State Department of Transportation (NYSDOT) Item
4 placed and rolled with a ten-ton roller ready for binder course.
(2) Heat and electricity shall be provided to the model
home and an Electrical Underwriters inspection performed to the satisfaction
of the Building Department.
(3) All permanent or temporary water and sewer services
to the model home shall be installed after prior approval by the Woodbury
Water and Sewer Superintendent. Where a subdivision is to be improved
with wells and septic systems, they shall be provided and installed
prior to the issuance of certificates of occupancy for the model homes.
(4) All ingress and egress to the model home shall be
provided for emergency services.
(5) Streetlighting shall be provided to the model homes
or, if none is provided, the hours of operation for the model homes
shall be limited to daylight hours.
