[Adopted 8-12-2008 by L.L. No. 6-2008]
It is the intention of this Part 3 to promote the general welfare of the people of the Village of Woodbury by providing for the enforcement of Part 2, Subdivision Regulations.
The Village Board of the Village of Woodbury finds that the Woodbury Planning Board adopted Subdivision Regulations on May 5, 1976, which requires the Village Board, as the legislative body of the Village, to enact provisions for the enforcement and penalties for the violation of Part 2, Subdivision Regulations.
Any person committing an offense against any provision of this Part 3 shall, upon conviction, be guilty of a violation pursuant to the Penal Law of the State of New York, punishable by a fine not exceeding $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The continuance of an offense for each day (24 hours) shall be deemed a distinct and separate violation.
Where any building or structure is erected, constructed, reconstructed, altered, converted or maintained; any building, structure or land is used; or any land is divided into lots, blocks or sites in violation of Part 2, Subdivision Regulations, the proper local authorities of the Village of Woodbury may institute any appropriate action or proceedings to prevent such unlawful erection, construction, reconstruction, alteration, conversion, maintenance, use or division of land; to restrain, correct or abate such violation; to prevent the occupancy of said building, structure or land; or to prevent any illegal act, conduct, business or use in or about such premises.
