[HISTORY: Adopted by the Board of Supervisors of the Township of Pennsbury 6-5-1995. Amendments noted where applicable.]
There is hereby adopted by the Township of Pennsbury for the purpose of prescribing regulations governing the design, construction, use or maintenance of all buildings and structures, the 1993 BOCA National Mechanical Code, Eighth Edition, and the whole thereof, save and except such portions as are hereinafter deleted, modified or added by § 100-3 of this chapter, three copies of which have been and are now filed in the office of the Township of Pennsbury, and the same is hereby adopted and incorporated as fully as if set out at length herein, and from the date on which this chapter shall take effect, the provisions thereof shall be controlling within the limits of the Township of Pennsbury.
Unless otherwise indicated, the following words shall be constructed to have the meaning hereafter indicated. The singular shall include the plural and the plural shall include the singular.
A. 
Whenever the word "municipality" is used in the Mechanical Code, it shall be held to mean the Township of Pennsbury, County of Chester, Pennsylvania.
B. 
Whenever the term "Code Official" is used in the Mechanical Code, it shall be held to mean the Code Enforcement Officer or his or her assistants.

M-113.2. Periodic Inspections: The fees for all periodic inspections shall be as indicated in the current Pennsbury Township Schedule of Fees, as set forth by resolution.

M-113.3. Fee Schedule: The fees for all mechanical work shall be as indicated in the current Pennsbury Township Schedule of Fees, as set forth by resolution.

M-116.3. Prosecution of Violation: If the notice of violation is not complied with promptly, the Code Official shall issue a non-traffic citation in accordance with the Pennsylvania Rules of Criminal Procedure, or the Code Official shall request the legal counsel of Pennsbury Township to institute the appropriate proceedings at law or in equity to restrain, correct or abate such violations or to require the removal or termination of the lawful occupancy of the building or structure in violation of the provisions of this code or of the order or direction made pursuant thereto.

M-116.4. Violation Penalties: Any person who shall violate a provision of the code or shall fail to comply with any of the requirements thereof or who shall install, alter or repair a mechanical system in whole or in part, in violation of an approved plan or directive of the Code Official, or of a permit or certificate issued under the provisions of this code, shall be guilty of a summary offense, punishable by a fine of not more than $1,000, or by imprisonment not exceeding 90 days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

M-801.2. Liquefied Petroleum Gas Storage: The storage system for liquefied petroleum gas shall be designed and installed in accordance with NFiPA 58 listed in Chapter 21, NFiPA 30 and NFiPA 31, as applicable.
