There is hereby created and established a Township Planning Commission consisting of seven members to be appointed by the Township Commissioner.

All members of the Planning Commission shall reside within the Township of South Whitehall. The present members of the Planning Commission shall continue in office until the expiration of the term for which they were appointed or until their successors are appointed and qualified.
The said members of the Commission shall serve in their respective capacities and perform the duties of said office without compensation.

The Planning Commission shall have the right and authority to promulgate rules and regulations to govern its procedures, and shall exercise those rights and fulfill those duties set forth in Article II, § 209, of the Pennsylvania Municipalities Planning Code, 1968, (P.L. 805), No. 247, which are not specifically delegated to the Township's Planning Department.
The Board of Commissioners may appropriate such money as, in its opinion is necessary and is available, for the work of the Planning Commission.
There is hereby created a "Township Planning Department," in accordance with and as defined by Article II, § 201, of the Pennsylvania Municipalities Planning Code, Act 247, of 1968, (P.L. 805). This Planning Department shall be known as the Township Community Development Department.
The Director of the Community Development Department shall be appointed in accordance with § 207, of the Pennsylvania Municipalities Planning Code, Act 247, of 1968, (P.L. 805), which stipulates that the appointing authority may appoint a Director of Planning who shall be, in the opinion of the appointing authority, qualified for the duties of this position. Such appointment shall be with the approval of the Board of Commissioners. The Township Manager shall constitute the "appointing authority" in accordance with § 50-7 of this Code which delineates the duties of the Township Manager.
Under the auspices of the Township Manager, the Community Development Department is hereby delegated the following powers, duties and responsibilities delineated in the Pennsylvania Municipalities Planning Code, Act 247 (P.L. 805), § 209.1:
A. 
Prepare, recommend and administer subdivision and land development, planned residential development regulations, as set forth in article.
B. 
Prepare and present to the Township Board of Commissioners a Building Code and a Housing Code, and make recommendations concerning proposed amendments thereto.
