Pursuant to § 11 of the Uniform Fire Safety Act ("UFSA") (P.L. 1983, c. 383; N.J.S.A. 52:27D-202), the New Jersey Uniform Fire Code ("NJUFC"), N.J.A.C. 5:70-1.1 et seq., shall be locally enforced in the Borough of Newfield.
The Borough of Newfield designates the Gloucester County Fire Marshal's Office as the Borough's local enforcement agency. The Gloucester County Fire Marshal's Office is hereinafter referred as the "local enforcing agency."
A. 
The local enforcing agency shall enforce the NJUFC in all buildings, structures and premises within the established boundaries of the Borough of Newfield, but not for one- and two-unit owner-occupied dwellings used exclusively for dwelling purposes or buildings, structures, or premises owned or operated by the federal government, interstate agencies or the state.
B. 
The local enforcing agency shall comply with the UFSA and NJUFC.
A. 
The local enforcing agency shall be under the direct supervision of the Fire Marshal of the County of Gloucester and not the Borough of Newfield.
B. 
The Fire Marshal shall provide monthly or annual reports requested by the Chief of the Newfield Fire Department or the Newfield Director of Public Safety to comply with any Borough insurance obligations or otherwise required by law.
Except as otherwise required by this chapter, the Borough of Newfield shall defer to the Gloucester County Fire Marshal's Office Ordinance ("GCFMOO") for matters concerning:
A. 
GCFMO organization or membership;
B. 
Appointment, terms of office, or qualifications of GCFMO officers;
C. 
Admission, training, supervision, discipline, or removal of GCFMO membership;
D. 
Inspection of both life hazard uses and non-hazard uses;
E. 
Permits and inspection fees for buildings, structures, and premises identified in § 130-3A;
F. 
Board of Appeals;
G. 
Enforcement of the NJUFC within the Borough of Newfield;
H. 
NJUFC violations and penalties; and
I. 
All other provisions of the GCFMOO not otherwise regulated by or inconsistent with this chapter.
