The following words, terms and phrases, when used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them as follows:
EXHIBIT
To display, project a film or to provide literature, film and projection equipment and/or facilities for group or individual viewing on the premises at any motion-picture theater, retail establishment or other public place within the Borough of Newfield.
FILM
Any motion picture, videotape or other type of moving picture or series of the same, whether full length or short subject, with or without a soundtrack.
OBSCENE LITERATURE AND FILM
Any description, narrative account or depiction of sexual activity or anatomical area contained in or consisting of a film or printed matter, which by means of posing, composition, format or animated sensual details:
A. 
Depicts or describes in a patently offensive way ultimate sexual acts, normal or perverted, actual or simulated, masturbation, excretory functions or lewd exhibition of the genitals;
B. 
Lacks serious literary, artistic, political or scientific value when taken as a whole; and
C. 
Is a part of a work which, to the average person applying contemporary community standards, has a dominant theme when taken as a whole which appeals to the prurient interest.
PERSON
Any individual, partnership, firm, association, corporation or other legal entity.
It shall be unlawful for any person to knowingly exhibit, present or offer for sale an obscene film or obscene literature within the Borough of Newfield.
Any person who shall violate any provision of this chapter shall be subject to a fine not exceeding $2,000, imprisonment for a term not exceeding 90 days, and/or a period of community service not exceeding 90 days, for each and every violation.
