The International Property Maintenance Code,
2006 Edition, is adopted as the Property Maintenance Code for the
Borough of Trappe, for the purpose of regulating and governing the
conditions and maintenance of all properties, buildings and structures
situate in the Borough, by providing the standards for supplied utilities
and facilities and other physical conditions essential to ensure that
properties, buildings and structures are safe, sanitary and fit for
occupation and use; the conduction of inspections to ensure compliance
with the provisions set forth in the above-noted Code; issuance of
associated permits and licenses as may be required by the Borough;
the issuance of fines, penalties and other remedies as set forth and
as otherwise permitted by Borough, state and federal law.
The following revisions and addenda to the International
Property Maintenance Code, 2006 Edition, are hereby adopted:
A. Section 101.1 Title. Insert "the Borough of Trappe".
B. Section 102.3 Application of other codes. Delete "...
the International Building Code, International Fuel Gas Code, International
Mechanical Code, and the ICC Electrical Code.", and insert "... the
Uniform Construction Code, as adopted by the Commonwealth of Pennsylvania
and the Borough of Trappe, and all other Codes as adopted by the Borough
of Trappe."
C. Section 102.3 Application of other codes. Delete "...
the International Zoning Code.", and insert "... the Zoning Ordinance
of the Borough of Trappe."
D. Section 102.6 Historic Buildings. Delete "... for
existing buildings or structures designated as historic buildings
when such buildings...", and insert "... for existing buildings or
structures designated as historic buildings by the Commonwealth of
Pennsylvania or by the Federal Government when such buildings...".
E. Section 103.5 Fees. Delete "... shall be indicated
in the following schedule.", and insert "... shall be set forth by
Resolution of the Borough of Trappe.".
F. Section 104.7 Department Records. This section is
stricken in its entirety, and in lieu thereof this section shall read:
"The code official shall keep official records of all business and
activities of the department specified in the provisions of this Code.
Records shall be retained in accordance to the 'Retention and Disposition
Schedule for Records of Pennsylvania Municipal Government'.".
G. Section 107.2.5 Form. This section is stricken in
its entirety, and in lieu thereof this section shall read "Inform
the property owner of the right to appeal pursuant to Local Agency
Law, 2 Pa.C.S.A. §§ 751 and 752.".
H. Insert a new subsection 108.2.1 to read as follows:
"108.2.1 Vacant Buildings. It shall be unlawful for an owner or operator
to allow a building to remain vacant for a period in excess of six
months unless during said period the owner or operator thereof shall
provide documentation to the code official of a bona fide attempt
to sell or let the property.".
I. Add to Section of 108.4.1 Placard Removal as follows:
"No person shall occupy a placarded premises nor operate placarded
equipment until written approval is secured from and such placards
removed by the code official.".
J. Section 111 Means of Appeal. This section is stricken
in its entirety, and in lieu thereof this section shall read "The
property owner possesses the right to appeal decisions of the code
official in accordance with Local Agency Law, 2 Pa.C.S.A. §§ 751
and 752.".
K. Section 201.3 Terms Defined in Other Codes. Delete
"... the International Building Code, International Fire Code, International
Zoning Code, International Plumbing Code, International Mechanical
Code, or the ICC Electrical Code," and insert "... Uniform Construction
Code, as adopted by the Commonwealth of Pennsylvania and the Borough
of Trappe, and all other Codes as adopted by the Borough of Trappe,".
L. Section 202 General Definitions. Amend to include
the following definition: "Vacant Buildings — A building which,
if residential, has ceased to be occupied as a residence by any person
for a period in excess of six months and, if nonresidential, has ceased
to be occupied by any person, firm or corporation for a period in
excess of six months or is empty by the removal of all machinery,
equipment, inventory or merchandise, unless said residential or nonresidential
building is in the process of undergoing repair or renovation, which
repair or renovation necessitates the activity of persons in and about
the building on at least a weekly basis. A vacant nonresidential space
normally occupied within a building does not apply.".
M. Section 202 General Definitions. Amend the definition
of Inoperable Motor Vehicle from "... to being unlicensed, wrecked,
abandoned..." to "... to being unlicensed, unregistered with the Commonwealth
of Pennsylvania, wrecked, abandoned..".
N. Section 302.4 Weeds. Delete "... in excess of (jurisdiction
to insert height in inches)," and insert "... in accordance to the
Code of Trappe Borough.".
O. Section 302.4 Weeds. Amend to add the following: "Weed
and plant growth shall include that situate within any easement upon
the property and/or within any road or other right-of-way upon and/or
fronting the property, even if said right-of-way is dedicated to the
Borough. Property owners are likewise responsible to remove all weed
and plant growth situate between a curb and the roadway, even if said
roadway is a public roadway, and property owners shall keep that portion
of the roadway fronting his/her property free from glass clippings,
leaves, and all other debris at all times.".
P. Section 302.8 Motor Vehicles. Add a second exception,
as follows: "Exception: An Inoperative Motor Vehicle may be stored
inside a permanent structure.".
Q. Section 303.2 Enclosures. Amend to add the following:
"The fence or barrier shall not have openings, holes or gaps that
would permit the passage of a four-inch diameter sphere.".
R. Section 304.14 Insect Screens. Amend to include the
dates "June 1" to "November 1."
S. Section 602.3 Heat Supply. Amend to include the dates
"October 1" to "May 1."
T. Section 602.4 Occupiable Work Spaces. Amend to include
the dates "October 1" to "May 1."
U. Section 606 Elevators, Escalators and Dumbwaiters.
Deleted in its entirety.
The Borough Manager is appointed to the position
of Code Official, and for a term to run concurrent to his/her tenure
as Borough Manager, or until such time as Council appoints another
individual to said position.
Nothing in this chapter, and nothing in the
International Property Maintenance Code hereby adopted, shall be construed
to affect any suit or proceeding impending in any court, or any rights
acquired, or liability incurred, or any cause or causes of action
acquired or existing, under any act or ordinance hereby, nor shall
any just or legal right or remedy of any character by lost, impaired
to affected by his chapter.
In the adoption of this chapter, the Borough
of Trappe hereby adopts all revisions, updates and amendments and
subsequently adopted versions hereinafter made to the International
Property Maintenance Code, 2006 Edition, unless the Borough of Trappe
exempts and/or amends same.
