As used in this article, unless a different
meaning clearly appears from the context, the following words shall
have the following meanings:
ANNUAL SERVICE CHARGE
The annual charge herein imposed for the use and services
of the system upon the owners of the buildings served thereby, based
upon the applicable EDU.
BOROUGH
The Borough of Chesilhurst.
BUILDING
Any building or structure heretofore or hereafter constructed
and designed or used for dwelling purposes, either temporary or permanent,
or other use or occupancy by persons, and which is connected directly
or indirectly with the system.
COMMERCIAL USER
Such building or each part thereof designed or used for any
one or different professional, business, industrial, governmental,
public or private, religious or charitable use or purpose without
regard to the number of house connections from such building to the
system.
CONNECTION FEE
A one-time payment by a new customer for the connection rights
to a previously funded sewer system.
EQUIVALENT DWELLING UNIT (EDU)
For sewer rental purposes, a room, group of rooms or similar
structure or facilities occupied or designed for occupancy as separate
living quarters by a family or other group of persons living together
or by a person living alone, and commercial users, bars and restaurants.
An EDU equals 300 gallons of sewer flow per day.
LATERAL FEE
A one-time payment by a new customer for the cost of the
installation of piping between the street main and the curbline.
RESIDENTIAL USER
Each building or each part thereof designed for or used as
a residence or abode by a single family without regard to the number
of house connections from such building to the system.
SYSTEM
The sanitary sewerage system constructed, owned or operated
by the Borough for the collection and disposal of sanitary sewage
and other wastes.

A. An annual service charge is hereby fixed and established
for each equivalent dwelling unit in the Borough equal to $300 per
annum for each residential user in such building, for each commercial
user in such building and for each bar and/or restaurant in all such
buildings. The annual service charge shall be established each year
in the municipal budget pursuant to New Jersey Statutes (N.J.S.A.
40A:4-33 et seq.).

B. Schedule of equivalent dwelling units. In computing
the annual service charge for each structure, the number of equivalent
dwelling units shall be determined in accordance with Schedule A:

Borough reserves the right to determine the
gallons of flow per day associated with any project on the basis of
standards set forth by the NJDEP.

All churches, public schools, Borough facilities,
and the Chesilhurst Fire Company are exempted from the payment of
sewer charges to the Borough of Chesilhurst.

The Borough may impose an additional or special charge with respect to any unit from which there shall be discharging sanitary sewage or wastes of a particular content, type or volume, but in no event shall the annual service charge be less than the amount established pursuant to §
387-9A.

In addition to the annual service charge, a
fee for the lateral installation to the system shall be made at a
rate of $500 for a standard six-inch lateral connection, with a base
distance of 25 feet. Any distances greater than the base charge will
require an added cost to be determined prior to installation. This
charge shall be waived for all property owners who connect to the
system by March 1, 1995.
It will be the financial responsibility of each
property owner to provide maintenance service for any problems that
may develop with the sewer line connecting each structure to the sewer
system.
