§ 88-1 Purpose; statutory authority.

A. 
It is the purpose of this chapter to provide a Board of Recreation Commissioners for all residents of the Borough of Chesilhurst with the objective of developing a recreational program for the Borough of Chesilhurst.
B. 
It is the further purpose of this chapter to implement the provisions of N.J.S.A. 40:12-1 et seq. for the aforestated purposes.

§ 88-2 Establishment; membership.

A. 
There shall be established in the Borough of Chesilhurst a Board of Recreation Commissioners to consist of seven members who are residents of the Borough of Chesilhurst.
B. 
The Commissioners first appointed shall be appointed for terms of one, two, three, four and five years, respectively, in such manner that the term of at least one Commissioner and not more than two Commissioners shall expire each year, and thereafter all appointment shall be for the term of five years. Vacancies shall be filled for the unexpired term only.
C. 
The members of the Board of Recreation Commissioners shall be appointed by the Mayor with the advice and consent of the Council.
D. 
The Board of Recreation Commissioners shall be governed by the provisions of N.J.S.A. 40:12-1 through 40:12-8, as applicable.

§ 88-3 Organization.

A. 
The Board shall elect a Chairman and Vice Chairman from its members and shall select a Secretary who may either be a member of the Board or a municipal employee designated by the Board.
B. 
The Board shall create such committees as it deems necessary to create to carry out the objectives of the Board.
C. 
The Chairman shall appoint such persons as shall be required to each committee.

§ 88-4 Appointment of employees; compensation.

The Board may appoint a Secretary or Clerk, a Superintendent of Recreation and such number of custodians, supervisors and assistants as shall be necessary and proper for the carrying out of its functions, all subject to the approval of the governing body of the Borough of Chesilhurst. The salary, wages or other compensation to be paid to any employees of the Board shall be such as is fixed in the annual Borough Salary Ordinance by the governing body of the Borough, after consultation with the Board.

§ 88-5 Powers and duties.

The Board shall adopt such rules, regulations or bylaws as may be necessary to effectuate the provisions and purposes of the statute and this chapter and shall further have the following powers and duties:
A. 
Acquire lands for public playgrounds and recreation places, by gift or purchase, and from time to time select lands for public playgrounds and recreation places.
B. 
Cause surveys and maps to be made of any site so selected, together with a careful estimate, as nearly accurate as may be, of the probable cost of acquiring such lands; if it proposes to lease the lands in question, together with an estimate with the cost of preparing such land and suitably equipping the same to meet the objectives of this chapter.
C. 
Such other powers and duties as may be necessary to implement the intent of this chapter, and such other powers as may be given to the Board by N.J.S.A. 40:12-1 et seq.

§ 88-6 Acquisition of property.

The Board shall have the power to acquire property pursuant to this chapter and N.J.S.A. 40:12-4. The title of any lands taken under the provisions of this chapter or the statute shall vest in the municipality. Any such leases for land shall be in the name of the municipality. Any revenue realized from any such leases shall be deposited with the Treasurer of the Borough of Chesilhurst and kept by him/her in a special fund, which shall be under the control of the Board and used only for the purpose of defraying the expenses of improving, maintaining or policing the playgrounds and recreation places and for other expenses of the Board.

§ 88-7 Games and exhibitions; admission fees.

A. 
In order to provide the funds, in whole or in part, necessary to improve, maintain and police the playgrounds or recreation places under its control, the Board may arrange and provide for the giving of exhibitions, plays, concerts, games and contests and may use and employ such playgrounds or recreation places for the aforestated purposes.
B. 
The Board may charge and collect a reasonable admission fee for each person entering such playground or recreation place as a spectator during the time or times when the same is being used or employed for such purposes, but shall not use or employ any such playground or recreation place for such purpose for such periods of time as may be prescribed by this chapter, the bylaws, rules and regulations and N.J.S.A. 40:12-5.
C. 
When any such playground or recreation place is used for such purposes, no admission fee shall be charged or collected for children 11 years of age and younger.

§ 88-8 Control of grounds; preservation of order.

A. 
The Board shall have full control over all lands, playgrounds and recreation places acquired or leased under the provisions of this chapter and N.J.S.A. 40:12-1 through 40:12-8 and may adopt suitable rules, regulations and bylaws.
B. 
Any person who violates any of the aforestated while on or using the facilities governed by the Board shall be punished according to law, and any such infractions shall be a disorderly persons offense.
C. 
The custodians, supervisors and assistants appointed by the Board shall, while on duty and for the purpose of preserving order and the observance of the rules, regulations and bylaws of the Board, have all the power and authority of police officers of the Borough of Chesilhurst.
D. 
The Board may appoint a Recreation Director, for a term not to exceed three years, and such other persons as may be deemed necessary to carry out the purposes of the Board of the Borough of Chesilhurst, and fix and determine their salaries.

§ 88-9 Appropriations; meeting place.

A. 
The Council of the Borough of Chesilhurst, having control of the finances of the municipality, shall annually fix, determine and appropriate a sufficient sum for the care, custody, policing and maintenance of such playgrounds and recreation places, to be raised by taxes for use by the Board to facilitate this chapter.
B. 
The Council of the Borough of Chesilhurst shall provide a suitable place for the Board to meet from time to time.

§ 88-10 Required reports.

Annually, not later than January 31 in each year, the Board shall make and transmit to the governing body a written report summarizing all of its activities for the previous year and describing, so far as practicable, its projected activities for the coming year with particular emphasis intended to be given to any new programs to be implemented during the coming year, which report shall include a projection of the costs for each of the Board's activities. In addition to the activities report, the Board shall report, at the same time, to the governing body, the name, address, job description, number of hours of work performed and salary paid concerning each of the persons employed by the Board during the previous year.
