As used in this article, the following terms shall have the meanings indicated:
ADMINISTRATIVE FEE
A fee charged to the secondary employers at a daily rate to compensate the Borough of Chesilhurst for administrative expenses.
LEVELS OF EMPLOYMENT
A. 
LEVEL I EMPLOYMENTInside protective services, churches, synagogues and nonprofit organizations.
B. 
LEVEL II EMPLOYMENTOutside nontraffic protective services.
C. 
LEVEL III EMPLOYMENTTraffic direction and control assignments.
NON-POLICE-ORIENTED SECONDARY EMPLOYMENT
Any form of gainful employment, including self-employment, during the hours when the employee is off duty, where the employment capacity is not based upon the employee's authority as a police officer, and where the uniform of the Borough of Chesilhurst Police Department is not worn. (Examples: retail sales, real estate sales, family business, civil process server.) Employment of this type will require prior approval from the Chief of Police.
POLICE-ORIENTED SECONDARY EMPLOYMENT
The employment of a police officer during the hours when the employee is off duty, that requires the member to either wear a uniform or not wear a uniform, in a capacity where the purpose of the secondary employment is either based upon the employee's authority as a police officer or where employment is controlled by the guidelines set forth within the 1939 Private Detectives Act.
SCHEDULE COORDINATOR
A schedule coordinator is any employee of the Borough of Chesilhurst Police Department, who is an employee of the secondary employer, and who provides any and all of the following services for the secondary employer:
A. 
The scheduling of the employee himself or herself, or of other employees to work for one or more employers in a police-oriented secondary employment capacity.
B. 
Serving as a liaison between one or more police-oriented secondary employers and one or more employees.
C. 
Exercising any type of administrative control over one or more employees on behalf of one or more police-oriented secondary employers.
A. 
Certain Borough of Chesilhurst individuals, groups or organizations may request the use of off-duty Borough of Chesilhurst police officers.
B. 
Borough of Chesilhurst police officers may only accept secondary employment opportunities if:
(1) 
The event/assignment is to take place within the Borough of Chesilhurst; and
(2) 
The Borough of Chesilhurst does not require their services for the Borough at the time of the assignment.
C. 
Only supervisors are permitted to negotiate contracts with the individual, entity or organization requesting the assignment, and under the advice and consent of the Chief of Police.
D. 
All secondary employment must be approved by the Chief of Police or his designee.
E. 
Under no circumstances may any officer initiate contact with outside entities to procure secondary employment assignments.
All police-oriented secondary employment will be paid through the Borough of Chesilhurst payroll system at the following pay rates:
A. 
Personnel.

Level III
$75.00 per hour
Level II
$75.00 per hour
Level I
$75.00 per hour
B. 
Equipment use.
(1) 
Use of patrol: $15 per hour. A marked Borough vehicle will only be assigned for secondary employment at the discretion of the Chief of Police.
(2) 
Other equipment/vehicles. Should the assignment necessitate other than patrol vehicles, a separate additional fee may be charged at the Mayor's discretion in emergency situations.
C. 
Administrative fee.
(1) 
A flat fee of $5 per hour shall be assessed to every Level I, II and Level III secondary employment.
This contract is contingent upon officer availability. The contractor agrees to make payment (which will be deposited into an escrow account) to the Borough of Chesilhurst in advance of the services to be performed. Monies must be paid in accordance with the Borough of Chesilhurst pay period. If service is not needed the contractor must pay a minimum of three hours at the above rate if the services are not cancelled within five hours of the agreed upon times.
Any secondary employment that is mandated by the public amusement license and/or club license, or Borough ordinance, or employment that the Chief of Police considers a public safety issue, such as a school function, will be paid at the officer's contractual overtime rate with a four-hour minimum. Secondary employment of this type must also be paid in advance of services to be performed.
A. 
In order to secure the services of a police officer for secondary employment purposes, the individual entity or organization shall:
(1) 
Make application to the Borough, through the Borough of Chesilhurst Police Department, for these services; and
(2) 
Make payment to the Borough of Chesilhurst in advance of the services to be performed.
B. 
All procedures shall conform to the Borough of Chesilhurst Police General Orders.
