Except as otherwise expressly required by applicable state statute,
all appointments of subordinate officers or officials of the Borough,
as well as members of its various boards, commissions and committees,
where they are stated to be appointments by the Mayor with confirmation
(or advice and consent) by the Council, shall be construed to provide
that the Council, whenever it fails to confirm a nomination by the
Mayor within 30 days of being presented with a nomination to fill
that vacancy, shall have the power to make an appointment to that
office, board, commission or committee, provided that at least three
affirmative votes shall be required for such purpose, with the Mayor
to have no vote thereon except in the case of a tie, in accordance
with N.J.S.A. 40A:60-6(d).
