There is hereby created in the Borough a position
of Municipal Public Defender.
The Municipal Public Defender shall be a duly
licensed attorney-at-law of the state.
The Municipal Public Defender shall be appointed
by the Mayor and confirmed by the Council for the term of one year,
effective January 1 of each year and until December 31 of the same
year, and until the appointment and qualification of his or her successor.
The Municipal Public Defender shall be paid
such annual salary as provided for in the current Salary Ordinance
of the borough and such other reasonable compensation for the additional
services performed only upon authorization of the Council first secured.
The Municipal Public Defender shall appear in
the Municipal Court of the Borough on behalf of indigent defendants
as required by state laws and upon the request of the Judge of the
Municipal Court.
Applicants for representation by the Municipal
Public Defender or pro bono counsel pending appointment of the Municipal
Public Defender or in the event of a conflict of interest, or other
substitute counsel, shall submit a fee of $200, or as otherwise provided
by state law, to be refunded in the event the application is denied.
