No picnic, barbecue, outing or similar gathering of people shall be held within the Borough of Chesilhurst without first having applied for and obtained a license for such picnic, barbecue, outing or similar gathering in the manner hereinafter provided for.
Application for license for any such picnic, barbecue, outing or similar gathering shall be made in writing to the Borough Clerk, not less than 15 days prior to the date of the event to be licensed. The application shall state the name and address of the person sponsoring the picnic, barbecue, outing or similar gathering, the date of the event, the location of the gathering place, the name and address of the owner of the gathering place and the approximate number of persons attending. The application shall be accompanied by a license fee of $50. If the license is granted by Borough Council, the license fee shall be retained by the Borough. If the license is denied, the license fee shall be returned to the applicant.
This chapter shall not apply to, and no license shall be required for, any picnic, barbecue, outing or similar gathering:
A. 
Where there are less than 35 persons in attendance.
B. 
Where the gathering occurs on private property.[1]

Any violation of this chapter shall be punishable by a fine not exceeding $2,000, imprisonment for a period not exceeding 90 days and/or a period of community service not exceeding 90 days.
