The Borough Council, being the municipal authorities of the Borough of Danville, hereby signifies its intention and desire to organize an Authority under the provisions of the Municipal Authorities Act, 53 Pa.C.S.A. § 5601 et seq., as amended.[2]

The proper officers of the Borough are hereby directed, as required by the Municipality Authorities Act, 53 Pa.C.S.A. § 5601 et seq., to publish notice of this chapter and of the day upon which said Articles of Incorporation will be filed with the Secretary of the Commonwealth of Pennsylvania; to file said Articles of Incorporation, together with a certified copy of this chapter authorizing the incorporation of the Authority and the necessary proofs of publication, with the Secretary of the Commonwealth, and to do all other things necessary or appropriate to effect the incorporation of the Danville Municipal Authority.

The project which shall be first undertaken by the Authority shall be to construct a sewage disposal plant in the Borough for operation by the Authority or lease to the Borough as may be determined.

The Council of this Borough adopts and approves the amendment to the Articles of Incorporation of the Authority, as proposed by a resolution duly adopted by the Board of the Authority, a copy of which resolution, duly certified by the Secretary of the Authority, has been submitted to the Council of the Borough.

The amendment to the Articles of Incorporation of the Authority, which is adopted and approved, shall provide that the following paragraph shall be added to said Articles of Incorporation: "The term of existence of said Danville Municipal Authority shall be for a period ending on December 31, 2029."

Proper officers of the Authority are authorized to execute, verify and file the appropriate Articles of Amendment with the Secretary of the Commonwealth, and to take all other action and do all other things which may be necessary in order to accomplish the amendment of the Articles of Incorporation of the Authority in the manner herein adopted and approved.[1]
