As used in this chapter, the following terms
shall have the meanings indicated:
DROUGHT CONTINGENCY PLAN
A plan developed to define the actions required at various
stages of a drought emergency in order to protect public health and
safety, ensure essential water uses, equitably share available supplies
and conserve water resources.
WATER EMERGENCY DECLARATION
A declaration by the Chairman or Vice Chairman of the Danville
Municipal Authority, or in their absence, the Danville Borough Water
Superintendent, that due to any cause, including but not limited to
flood, fire, power failure, chemical or biological contamination or
lack of rainfall, there is a reasonable probability that the water
supply may not be adequate to meet the needs of the Danville area.
In the event of a water emergency declaration,
all users of the municipal water system shall immediately curtail
water usage as provided by the water emergency declaration. In the
event that the water emergency declaration is triggered by drought
conditions, then the drought contingency plan shall take effect and
water usage shall be curtailed in accordance with said plan.
In the event that any user does not comply with the terms of any water emergency declaration, such user may be subject to termination of water service by the Authority, in addition to the penalties provided in §
252-5 of this chapter and the penalties provided in any drought contingency plan and its appendixes.
The Borough Police Department is authorized
to enforce the terms of this chapter.
Any person who shall violate any of the provisions
of this chapter shall, upon conviction thereof, be punishable by a
fine of not more than $100 for a first offense, $200 for a second
offense and $300 for a third or subsequent offense, together with
court costs or, upon default of payment of such fines and costs, by
imprisonment in the county jail for a term of not more than 30 days.
The continuation of such violation for each successive day shall constitute
a separate offense.
