In areas where permanent improvements are to be located in or on land that is not or will not be publicly owned, permanent easements shall be required. Said easements:
A. 
Shall have a minimum width of 30 feet.
B. 
Shall provide usable access to a public way.
C. 
Shall be reviewed and approved by the Town Attorney.
D. 
Can be released only at the discretion of the Town Board.
Where a subdivision is traversed by a watercourse, drainageway, channel or stream, there shall be provided a stormwater easement or drainage right-of-way conforming substantially to the lines of such watercourse and such further width or construction, or both, as will be adequate for the purpose.
