The Town Meeting of the Town of New Milford hereby declares
that a local housing partnership be formed, in accordance with Public
Act No. 88-305, in order to develop ways to increase the supply and
availability of affordable housing in the Town of New Milford.

There is hereby created the New Milford Housing Partnership
(hereafter, "partnership"), established under the authority of Public
Act No. 88-305, "An Act Establishing the Connecticut Housing Partnership
Program."

The Partnership shall have all powers and duties which are conferred
and imposed by Public Act No. 88-305 and by this article and such
other powers and duties as are conferred and imposed upon Town commissions
by the Town Charter.

The Partnership shall be composed of the following members appointed
in the manner provided for in Section 1002 of the Town Charter, provided
that the total number of members shall not exceed 15:
(2) Two members of the Town Council;
(4) One member of the Planning Commission, one member of the Zoning Commission,
one member of the Inland Wetlands Commission, one member of the Economic
Development Commission and one member of the Commission of the Aging;
(5) At least one but not more than three representatives of the local
business community, such as local bankers, realtors and developers;
(6) At least one but not more than three representatives of public interest
groups, such as housing advocates, members of the clergy, members
of local civic groups and representatives of local nonprofit corporations;
and
(7) At least one but not more than three local urban planning, land use
and housing professionals.

The term of office of each member of the Commission shall begin on December 1, 1988. The Mayor and the Town Planner shall be permanent members of the Partnership. The initial term(s) of office of the members of the Partnership listed in Subsections
(2) and
(4) of §
2-125 of this article shall expire on November 30, 1989. The initial terms of office of the members of the Partnership listed in Subsections
(5),
(6) and
(7) of §
2-125 of this article shall expire on November 30, 1990. Thereafter, members shall serve for terms of two years, commencing on December 1 and ending on November 30. Each member shall serve until the expiration of his or her term and until a successor has been appointed and qualified.

Any vacancy in the membership of the Partnership, from whatever
cause arising, may be filled for the unexpired portion of the term
vacated in the manner provided for in Section 1003 of the Town Charter.

Any member of the Partnership, except for the Mayor, may be
removed for good cause by the Mayor with the approval of the Town
Council. The unexcused absence of a member from three consecutive
regular meetings of the Partnership shall be deemed good cause for
removal.

A majority of the members of the Partnership shall constitute
a quorum for the conduct of meetings. The Partnership shall have the
power to adopt rules and regulations for the conduct of its meetings.
Meetings shall be noticed and conducted in the manner directed by
Chapter 3 of the Connecticut General Statutes. At its first regular
meeting, the Partnership shall elect a Chair and such other officers
as it may deem appropriate. Special meetings may be called by the
Chair of the Partnership at any time and shall be called upon written
request of any three members. No action by the Partnership shall be
valid unless authorized by a majority of the members present and voting.

In order to receive initial designation under the Connecticut
Housing Partnership Program pursuant to Public Act 88-305, the Partnership,
no later than 30 days after the date of its first regular meeting,
shall:
(1) Submit evidence to the Commissioner of Housing that the Partnership
has been formed in accordance with the provisions of Public Act 88-305;
and
(2) Submit evidence to the Commissioner of Housing that sufficient local
resources have been committed to the partnership.

In order to receive development designation under the Connecticut
Housing Partnership Program pursuant to Public Act 88-305, the Partnership
shall have the following duties and responsibilities:
(1) To examine and identify housing needs and opportunities in the community;
(2) To explore the availability of any state, municipal or other land
that is suitable for the development of affordable housing;
(3) To review applicable zoning regulations to determine whether such
regulations restrict the development of affordable housing in the
community and to identify any necessary changes to such regulations;
(4) To establish priorities and develop a long-range plan to meet identified
housing needs in the community consistent with regional housing needs;
(5) To establish procedures for the development of a written proposal
to achieve such priorities in accordance with said plan; and
(6) To start and carry out an activity, development or project designed
to create additional affordable housing in the Town of New Milford,
subject to such federal, state or local approval as may be required.
Notwithstanding the other provisions of this section, no expenditure
or commitment to make an expenditure shall be made, caused to be made
or authorized by the Partnership, its agent or any member of the Partnership,
unless an appropriation shall have been made covering such expenditure
or commitment in accordance with the provisions of the Town Charter.

The Partnership may hire employees or retain private consultants,
as it deems necessary, with such funds as may be appropriated for
such purposes.

On June 1, 1989, and once every six months thereafter, the Partnership shall submit a written report to the Town Council. The report shall describe the progress of the Partnership in carrying out each of the duties set forth in §§
2-130 and
2-131 of this article and the assistance provided to the Partnership to date by the State Commissioner of Housing pursuant to Section(c) of Public Act 88-305. The Town Council may require the Partnership to submit such other reports or information as the Town Council deems necessary to apprise it of the Partnership's progress in carrying out the mandate of the Connecticut Housing Partnership Program to develop ways to increase the supply and availability of affordable housing in the Town of New Milford.

This Article shall not be construed to conflict with any state
or federal statute, rule or regulation.
