In addition to the current zoning laws, incineration of any
type (waste to energy) that burns waste, garbage, rubbish, refuse,
trash or debris is not allowed on any public or private property within
the Town of New Milford, except that the incineration of wood or coal
in residential stoves or fireplaces for the primary purpose of providing
a source of residential heat shall be permitted.

(a) The burial of fly ash and waste ash in any landfill within the Town
of New Milford is prohibited, except that ash from residential wood
or coal incineration generated within the Town of New Milford and
ash collected within the Town of New Milford by chimney sweeps in
the normal course of business may be buried in a landfill within the
Town of New Milford, provided that a permit authorizing such disposal
is obtained in accordance with the provisions of this section.
(b) Any person engaged in cleaning chimneys on a commercial basis must
apply for an ash disposal permit from the Fire Marshal's office.
(c) Records must be kept to identify the sources of the ash. Such records
shall be available to the Landfill Inspector if requested.

(a) The provisions of §§
7-55 and
7-56 of this Article shall not apply to the following incinerators registered with or permitted by the Department of Environmental Protection:
(1) The New Milford Hospital incinerator located at 21 Elm Street, New
Milford, Connecticut; and
(2) The Balmoral Pet Cemetery incinerators located at Route 7, Gaylordsville,
New Milford, Connecticut.
(b) In addition, §§
7-55 and
7-56 of this Article shall not be deemed to prohibit the repair, maintenance, improvement or replacement of such incinerators.
