The owner of any residential property, prior to rental, lease
or transfer of ownership involving a change of residential occupancy
of any dwelling or unit of dwelling space in such property, shall
obtain a certificate of occupancy for the dwelling or unit of dwelling
space from the Housing Officer of the Township of Alloway. The Housing
Officer of the Township of Alloway shall issue such certificate of
occupancy only after he inspects the dwelling or unit of dwelling
space and finds that such dwelling or unit of dwelling space meets
the standards of the New Jersey State Housing Code and the Land Development
Ordinance of the Township of Alloway. A new inspection and certificate
of occupancy shall be obtained each time there is change of occupancy
of any dwelling or unit of dwelling space in any residential property
prior to the new occupancy.
The fee for said inspection and certificate of occupancy shall
be $25 for the first two inspections of the same dwelling or dwelling
unit and $50 for each subsequent inspection necessary until a certificate
of occupancy is issued.
As used in this chapter, the following terms shall have the
meanings indicated:
DWELLING
A building or structure or part thereof containing one or
more dwelling units or lodging units.
DWELLING UNIT or UNIT OF DWELLING SPACE
Any room or group of rooms or any part thereof located within
a building and forming a single habitable unit with facilities which
are used or designed to be used for living, sleeping, cooking and
eating.
OWNER
The person, organization or corporation who owns, purports
to own or exercises control of any residential property.
Any person, organization or corporation violating any of the
provisions of this chapter shall, upon conviction thereof, be punishable
by a fine not exceeding $1,000 or imprisonment of not more than 90
days or a period of community service not exceeding 90 days, or any
combination of said penalties.
