Pursuant to Section 11 of the Uniform Fire Safety Act (P.L. 1983, c. 383),[1] the New Jersey Uniform Fire Code shall be locally enforced in the Township of Alloway.

The local enforcing agency shall be the Alloway Township Fire Company.
The local enforcement agency shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of Alloway, other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.
The local enforcing agency established by § 62-2 of this chapter shall carry out the periodic inspections of life hazard uses required by the Uniform Fire Code on behalf of the Commissioner of Community Affairs.

A. 
Appointment of Fire Official. The local enforcing agency, in carrying out its duties under the Uniform Fire Safety Act, shall be under the direct supervision of the Fire Official who shall be appointed by the Township Committee. In making this appointment, the Township Committee will make the appointment from among a list of at least three qualified persons recommended by the Fire Chief of the Alloway Township Fire Company if such a list is submitted by him to the Township Committee in December of the year preceding the appointment. The Fire Official shall be under the direct supervision of the Alloway Township Fire Company Chief or his designee.

B. 
Duties of the Fire Official. The duties of the Fire Official shall be those prescribed in N.J.A.C. 5:18A-3.3.
C. 
Term of office. The Fire Official shall serve for a term of one calendar year, ending on December 31 of the year for which appointed. Any vacancy shall be filled for the unexpired term.
D. 
Employees. Such other inspectors or employees as may be necessary in the local enforcing agency shall be appointed by the Township Committee from among qualified persons recommended by the Chief of the Alloway Township Fire Company for terms of one calendar year each, ending on December 31 of the year for which appointed. Any vacancy shall be filled for the unexpired term.
E. 
Removal from office. Inspectors and other employees of the enforcing agency shall be subject to removal by the Township Committee for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the Township Committee or a designated hearing officer.
Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act, any person aggrieved by any order of the local enforcement agency shall have the right to appeal to the Construction Board of Appeals at Salem County.

A. 
In addition to the registrations required by the Uniform Fire Code, the following non-life-hazard uses shall register with the Bureau of Fire Prevention.

(2) 
R/A uses shall be inspected and charged a fee only upon sale or change of tenant.
(3) 
Uses not classified above that are subject to the Uniform Fire Code shall be classified as business uses.
(4) 
Uses required to register with the state as life hazard uses shall not be required to register under this section.
(5) 
Mixed uses. Full fee shall be charged for main use and half fee for other uses; nonprofit organization: fee exempt, but permit required.
B. 
Permits. The permit fees established by the Uniform Fire Code shall be charged by the Township of Alloway. These charges may be obtained from the Fire Official. All charges previously specified by the chapter are hereby repealed and in their place shall be interposed the permit fees established by the Uniform Fire Code. (Nonprofit organizations are exempt from the payment of a fee; however, such organizations must obtain required permits.)
C. 
The permit fees and non-life-hazard fees shall be collected by the Fire Official and placed in the Alloway Township current fund and recorded in the revenue account entitled "Fire Safety Permit Fees."

D. 
A penalty trust account shall be set up in accordance with N.J.A.C. 5:70-2.12 and N.J.A.C. 5:70-2.12A.
E. 
Board of Appeals. Pursuant to Sections 15 and 17 of the Uniform Fire Safety Act,[1] any person aggrieved by any action of the local enforcing agency shall have the right to appeal to the Construction Board of Appeals of Salem County.

The fees for registration, certificate of smoke detector compliance, and permits shall be those established by the State Uniform Fire Code, N.J.A.C. 5:70-2.3 the fees shall be as listed below:

B. 
Reinspections for failed/no-show inspection shall be the same fee schedule us initial inspection. Payment must be made in the form of a check or money order made payable to the Township of Alloway. Payment must be received at the time of the inspection.

The Fire Official shall mail or deliver to the Chief of the Alloway Fire Company and to the Township Clerk a copy of any serious violations of the Fire Prevention Code and shall consult with the Chief periodically regarding any suspected violations that have come to the attention of the Fire Company.

No permit fees for inspections under the New Jersey Fire Prevention Act[1] shall be charged for inspection of property operated by a religious organization or operated or owned by a public body.[2]
