B.
In the event of any conflict between this chapter and the Rules and
Regulations of the Police Department, or with any other chapter of
the Borough Code, the provisions of this Chapter shall prevail.
C.
To the extent not inconsistent herewith, the Rules and Regulations
of the Emerson Police Department, adopted by ordinance, by the Borough
of Emerson governing body, shall remain in full force and effect.
Nothing contained in this chapter shall be construed to terminate
the employment of any member of the Police Department nor to require
any member to comply with the provisions concerning new applications
or appointments. The members of the Police Department, upon the date
of the adoption of this chapter, shall continue to serve without reappointment
in their present ranks and at their present salaries.
A.
If any section, subsection, sentence, clause or phrase of this chapter
is for any reason held to be unconstitutional, invalid or unenforceable
by a court of competent jurisdiction, such decision shall not affect
the remaining portions of this chapter.
B.
Any ordinance inconsistent with the terms of this chapter is hereby
repealed to the extent of such inconsistency.
This chapter shall take effect upon passage and publication
according to law.
