A. 
No person shall own, possess or harbor any animal that frequently or for continued duration makes sounds that create a noise disturbance across a residential real property line.
B. 
For the purpose of this article, a "noise disturbance from a barking dog" shall be defined as that created by a dog barking continually for 10 minutes or intermittently for 30 minutes unless provoked.

Any person who violates or refuses to comply with the regulations of this article shall be liable to a penalty of not less than $10 nor more than $25 for each offense, to be recovered by and in the name of the Borough. The provisions of this article are supplementary and in addition to any applicable laws of the State of New Jersey.
The provisions of this article shall be enforced by the Animal Control Officer of the Borough of Emerson or the Board of Health of the Borough or its designated agent. No person shall hinder, molest or interfere with anyone authorized or empowered to perform any duty under this article.
Nothing in this article shall be construed to change or affect the provisions of any ordinance passed by the Mayor and Council of the Borough of Emerson relating to the registration, licensing and confinement of dogs in general within said Borough.
